REPORT OF THE CITY PLANNING COMMISSION <br />The.- Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />September 12, 1960 <br />The attached petition of Monsignor Elmer G. Peterson, Sacred Heart Church for Diocese of Fort Wayne, Inc., to annex <br />to the City of South Bend the following described property: Beginning at a point in the SW'k, Sec. 27, T38N, R2E, at <br />the intersection of the East -West centerline of Section 27 and the present North -South city limits, thence South <br />along said City Limits for a distance of Six Hundred Eighty and Seventy -Four Hundredths (680.74) feet to a point of <br />intersection of said City Limits and the North line of Highland Cemetery extended East, thence West along the North <br />line of Highland Cemetery for a distance of Five Hundred Eighty (580) feet, more or less, to a cross in a concrete <br />marker, thence North for a distance of Six Hundred Eighty and Seventy -four Hundredths (680.74) feet to the East -West <br />centerline of said Section 27, thence East along the East -West centerline of said Section 27, for a distance of <br />Five Hundred Eighty (580) feet, more or less, to the point of beginning containing approximately Nine (9) acres was <br />legally advertised on August 22, 1960 and given public hearing under date of September 8, 1960. The following actiot <br />was taken: <br />After due consideration the Commission found that in their opinion: <br />1. The annexation is in the best interests of the city and of the territory sought to be annexed <br />2. The area is urban in character, being an economic and social part of the annexing city. <br />3. The city is financially able to provide municipal services to the annexed area within the reasonably near future, <br />4. The area sought to be annexed is needed for development of the city in the reasombly near future. <br />5. Motion carried. <br />REPORT OF CITY PLANNING COMMISSION <br />The Honorable Common Council <br />City of South Bend <br />South Bend, Indiana <br />Gentlemen: <br />September 12, 1960 <br />The attached petition of the South Bend City Planning .Commission to rezone Lots Numbered 27, 28, and 29, Jackson <br />Sub., (Proposed) and the property directly across the street from the above lots being described as beginning at <br />a point 830 feet, more or less, west of the Northeast corner Quarter Section 34, T38N, R2E, thence east along the <br />North boundary line of said Quarter Section 185 feet, more or less, thence south parallel to the East boundary line <br />of said Quarter Section 206 feet, more or less, thence west parallel to the North boundary line of said Quarter <br />Section 110 feet, more or less, thence northwest to the point of beginning 220 feet, more or less, the above listed <br />properties being more generally described as lying in the 2200 block of Portage Avenue, from "C" Commercial Use to <br />"All Residential Use and "A" Height and Area District was legally advertised on August 22, 1960 and given public <br />hearing under date of September 8,� 1960. The following action was taken: <br />After due consideration the Commission found that since the area in question has been zoned commercially for thirty <br />years and as yet has not been so used is a clear indication that commercial use of the property is unlikely and that <br />since the majority of the land in the immediate area is zoned "A" Residential and sufficient commercial zoning <br />exists in said general area that the petition should be recommended favorably. Motion carried. <br />ORDINANCE NO. 4334 - - -60 <br />AN ORDINANCE AMENDING AND SUPPLEMENTING ZONING ORDINANCE NO. 3702, AS HERETOFORE <br />AMENDED AND SUPPLEMENTED (501 North Olive Street) <br />The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion for <br />suspension of Rules. Councilman Lehman seconded the motion. Motion carried by a roll call vote of 8 ayes, 0 nays, <br />1 absent (Councilman Allen).. The Ordinance was then given third reading and passed by a roll call vote of 8 ayes, <br />0 nays, 1 absent (Councilman Allen). <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE NO. 3702 COMMONLY KNOWN'AS THE ZONING ORDINANCE <br />OF THE CITY OF SOUTH BEND, INDIANA <br />(REAL ESTATE INVOLVED LOCATED ON PORTAGE AVENUE) <br />The Ordinance was given first reading by title and second reading in full. Councilman Muszynski made a motion that <br />the Ordinance be set for public hearing at the next regularly scheduled meeting of the Council. Councilman Tellson <br />
