<br />Bill filed April &th; 1843 alleges that Alexis Cogaillarci on July
<br />22nd, 1841, executed and delivered to orator his certain Jtijortgage cleed in
<br />fee simple conveying the following described tracts of land situate in the
<br />County of St. Joseph aforesaid, towit: (Land not herein considered), & the
<br />Vlest 2 of the North East 9, (except 10 acres off the i1orth end thereof) , all
<br />in Section 3 in Townshipe 2 East (d other land) to secure the
<br />37 of Ran g an

<br />payment of 5,639.85 according to the tenor of 12 promissory notes (des-
<br />cribe(I at 110. 9 above) . Copy of Mortgage No. 9 set out describing the Iffest
<br />j of the North East 4 (excepting 10 acres off the north end thereof') of Sec-
<br />tion 3, Township 37 North, Range 2 East, etc. That on November 12th, 1841,
<br />Alexis Cogaillazrd executed and delivered to John D. Defrees a deed in.fee
<br />simple, conveying to said Defrees the several tracts of land hereinbefore men-
<br />tioned, in consideration whereof, the said Defrees on the same day signed
<br />said
<br />12 promissory notes specified in said Mortgage. That on April 5th, 1843,
<br />orator and said Alexis coquillard and John D. Defrees in consideration
<br />of the settlement of divers difficulties and misunderstandings heretofore
<br />existing between said parties, executed a certain article of agreement,
