REGULAR MEETING OCTOBER 22, 2012 BILL NO. 44-12 PUBLIC HEARING ON A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROPRIATING MONIES FOR THE PURPOSE OF DEFRAYING THE EXPENSES OF THE DESIGNATED ENTERPRISE FUNDS OF THE CITY OF SOUTH BEND, INDIANA, FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2013 AND ENDING DECEMBER 31, 2013, INCLUDING ALL OUTSTANDING CLAIMS, AND OBLIGATIONS, AND FIXING A TIME WHEN THE SAME SHALL TAKE EFFECT Council Attorney Kathleen Cekanski-Farrand advised that Substitute Bill No. 42-12; Bill No. 43- 12 and Bill No. 44-12, will need a motion to continue those bills in the Council Portion and to have Second and Third Reading at the Special Meeting set for October 29, 2012 at 6:00 p.m. in th the Council Chambers, 4 Floor County-City Building, 227 W. Jefferson Blvd., South Bend, Indiana. Councilmember Oliver Davis made a motion to accept the above mentioned motion by the Council Attorney. Councilmember Dieter seconded the motion which carried by a voice vote of nine (9) ayes. BILL NO. 38-12 PUBLIC HEARING ON A BILL AMENDING THE ZONING ORDINANCE AND REQUESTING A SPECIAL EXCEPTION FOR PROPERTY LOCATED AT 3529 AND 3527 WESTERN AVENUE, SOUTH BEND, INDIANA, 46619, COUNCILMANIC DISTRICT NO. 6 IN THE CITY OF SOUTH BEND, INDIANA Councilmember Oliver Davis made a motion to continue this bill until the November 12, 2012, meeting of the Council. Councilmember Dieter seconded the motion which carried by a voice vote of nine (9) ayes. BILL NO. 35-12 PUBLIC HEARING ON A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING THE ZONING ORDINANCE AND ESTABLISHING HISTORIC LANDMARK STATUS FOR THE STRUCTURE AND REAL PROPERTY KNOWN AS THE AVON THEATRE AND LOCATED AT 307 SOUTH MICHIGAN, IN THE CITY OF SOUTH BEND, INDIANA Councilmember Oliver Davis, Chairperson, Zoning & Annexation Committee, reported that this committee held a meeting this afternoon and it was the consensus of the committee to send this bill to the full Council with no recommendation. Mr. Tim Klusczinski, 617 Park Avenue, South Bend, Indiana, advised that he currently serves as President of the Historic Preservation Commission (HPC) of South Bend & St. Joseph County, Indiana. The HPC is one of this State’s three oldest preservation authorities. It’s an honor to address the Council this evening.
