REGULAR MEETING OCTOBER 22, 2012 <br /> <br /> <br /> <br /> <br />BILL NO. 44-12 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA APPROPRIATING MONIES <br /> FOR THE PURPOSE OF DEFRAYING THE <br /> EXPENSES OF THE DESIGNATED <br /> ENTERPRISE FUNDS OF THE CITY OF SOUTH <br /> BEND, INDIANA, FOR THE FISCAL YEAR <br /> BEGINNING JANUARY 1, 2013 AND ENDING <br /> DECEMBER 31, 2013, INCLUDING ALL <br /> OUTSTANDING CLAIMS, AND <br /> OBLIGATIONS, AND FIXING A TIME WHEN <br /> THE SAME SHALL TAKE EFFECT <br /> <br />Council Attorney Kathleen Cekanski-Farrand advised that Substitute Bill No. 42-12; Bill No. 43- <br />12 and Bill No. 44-12, will need a motion to continue those bills in the Council Portion and to <br />have Second and Third Reading at the Special Meeting set for October 29, 2012 at 6:00 p.m. in <br />th <br />the Council Chambers, 4 Floor County-City Building, 227 W. Jefferson Blvd., South Bend, <br />Indiana. <br />Councilmember Oliver Davis made a motion to accept the above mentioned motion by the <br />Council Attorney. Councilmember Dieter seconded the motion which carried by a voice vote of <br />nine (9) ayes. <br /> <br /> <br />BILL NO. 38-12 PUBLIC HEARING ON A BILL AMENDING <br /> THE ZONING ORDINANCE AND <br /> REQUESTING A SPECIAL EXCEPTION FOR <br /> PROPERTY LOCATED AT 3529 AND 3527 <br /> WESTERN AVENUE, SOUTH BEND, INDIANA, <br /> 46619, COUNCILMANIC DISTRICT NO. 6 IN <br /> THE CITY OF SOUTH BEND, INDIANA <br /> <br /> <br />Councilmember Oliver Davis made a motion to continue this bill until the November 12, 2012, <br />meeting of the Council. Councilmember Dieter seconded the motion which carried by a voice <br />vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 35-12 PUBLIC HEARING ON A BILL OF THE <br /> COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING THE ZONING <br /> ORDINANCE AND ESTABLISHING HISTORIC <br /> LANDMARK STATUS FOR THE STRUCTURE <br /> AND REAL PROPERTY KNOWN AS THE <br /> AVON THEATRE AND LOCATED AT 307 <br /> SOUTH MICHIGAN, IN THE CITY OF SOUTH <br /> BEND, INDIANA <br /> <br />Councilmember Oliver Davis, Chairperson, Zoning & Annexation Committee, reported that this <br />committee held a meeting this afternoon and it was the consensus of the committee to send this <br />bill to the full Council with no recommendation. <br /> <br /> <br />Mr. Tim Klusczinski, 617 Park Avenue, South Bend, Indiana, advised that he currently serves as <br />President of the Historic Preservation Commission (HPC) of South Bend & St. Joseph County, <br />Indiana. The HPC is one of this State’s three oldest preservation authorities. It’s an honor to <br />address the Council this evening. He stated that he would like to have his comments made part <br />of the Council record: “I don’t believe the local media fully presented the HPC’s position on the <br />8 <br /> <br /> <br />
