RHONDA SAUNDERS: I have talked to Mr. Philippis several times, regarding what
we are requesting. I also sent him the names of four different tree trimming firms in the
area that have on staff arborists and may be able to assist Mr. Philippis in this matter.
Mr. Philippis did contact one of the firms, however, their bid for the project came in too
high. I have not heard from Mr. Philippis since and do not believe he has had enough
time to hire a firm by this meeting.

DONNA BROWN: I looked up the definition of the word damage in the dictionary; it
states that damage is injury that directly impairs appearance, value, usefulness,
soundness, etc. I would still contend that any trimming at the property line would
damage appearance of the tree and I would really hate to see the Commission set a
precedent that says that cutting of mature trees at the property line of historic properties is
permitted. I have five neighbors, all of which have at least as many walnuts dropping on
them as Mr. Philippis and none of them complain. I hope that you would take damage as
damage to appearance into consideration.
- -108 - - - - - - ---
JOHN OXIAN: Several of the commission members did meet on site. The State
Forester did not recommend cutting the branches at the property line that is why you have
such a general description from the committee. What we are doing is leaving it up to the
commission to either approve or deny a trimming plan. I would like to put the matter
back into the Committee for final approval or denial of the application. There were
enough Commission members present that the issue does not need to come before the
Commission as a whole again.

JOANN SPORLEDER: The forester did say that the trim job that had been done in
the past was detrimental to the tree. He did suggest that the dead branches remaining
from the previous trim job need to be removed and other areas corrected. It was not his
direct recommendation, however, he did give a general statement that further tree
trimming should not be allowed.

DONNA BROWN: I have been working with a tree trimmer to get the dead branches
removed from the walnut tree.

MARTHA CHOITZ: I think that the issue is frivolous; the tree should not be
trimmed anymore. The limbs in question do not hang over the house and walnuts do not
damage roofs. The tree is beautiful and is at least 200 years old and should not be
trimmed anymore.

RICHARD MORRISON: I move to approve the recommendation given by the
Committee and that the final decision be given to the Committee with the stipulation that
an arborist be consulted to review the plan given by the applicant.

GERALD UJDAK: I second the motion.

After due consideration, the following action was taken:

W
