Call to Order <br />The meeting was called to order at 7:40 p.m. <br />7th Floor, County Commissioner's <br />Conference Room, County -City Bldg. <br />II. Roll Call <br />Members present: Mrs. Martha Choitz; Mrs. Catherine Hostetler; Mr. John Oxian; <br />Mrs. Janeanne Petrass; Ms. Lora Spaulding; Ms. Jewel Van Dalsen; Mr. Jerry Wiener <br />Members absent: Mr. Jed Eide; Mrs. Joann Sporleder <br />Staff present: Chip Frederick- Administrative Assistant <br />Also present: Aladean DeRose- Deputy City Attorney; Dennis J. Laskowski -615/617 <br />Riverside Drive; Kevin Boughal-South Bend Tribune; Mike Bruno -1228 East Wayne; <br />Marsha Stevenson -1093 Riverside Drive; Ed Talley -1081 Riverside Drive; Anne Graham <br />Price -1049 Riverside Drive <br />III. Public Hearing <br />A. Certificates of Appropriateness <br />Mrs. Petrass moved to reposition 615/617 Riverside Drive as the last C of A <br />on the agenda. Mrs. Choitz seconded the motion. There was no discussion. <br />Motion approved unanimously. <br />1. Shetterley Park Fountain -Riverside Drive-LHD <br />Mr. Frederick read the staff report. Mr. Oxian introduced several other <br />photographs of the proposed fountain. Mr. Talley spoke against the proposal. He <br />detailed the effort to bring water back to the park and the general history of <br />drinking fountains in Shetterley Park. He then requested that the HPC deny the <br />proposal. Mrs. Choitz asked about Health Dept. restrictions concerning fountain <br />design. Mr. Talley replied that he had not considered the matter. Mr. Oxian then <br />asked about the originality of the Leeper Park fountains. Mr. Talley replied that they <br />were original to the park but had been moved several times previously. Mr. Oxian <br />stated that part of Leeper Park was in a LHD. Mr. Talley responded that the fountains <br />in question were not in a LHD. Mrs. Choitz asked that the HPC be in compliance <br />with other City departments. Discussion ensued about vandalism. Mr. Oxian then asked <br />counsel about approving the COA but requesting a different fountain. Ms. DeRose <br />stated that was not possible. Mrs. Choitz asked whether the COA could be tabled. <br />Ms. DeRose indicated that a signed waiver must accompany a motion to table and that <br />the city was unrepresented at the meeting. Further she stated that as a practical <br />matter the HPC had all of the information necessary to decide the issue. Mr. Wiener <br />moved to reject the COA. Mrs. Hostetler seconded the motion. No further discussion. <br />The motion to reject the COA application on the grounds of inappropriateness to the <br />Riverside Drive-LHD was approved unanimously. <br />2. 1228 East Wayne St.—East Wayne-LHD <br />Mr. Frederick read the staff report. Mr. Bruno stated that he may leave <br />the fence unpainted. Mrs. Choitz replied that the HPC " does not deal with paint". <br />Mr. Oxian questioned Mr. Bruno about the relocation of a portion of the 42" high <br />fence to behind the garage. Mr. Oxian stated that the COA application should reflect <br />the moving of that fence as well as the installation of the new privacy fence. <br />Mrs. Choitz moved that the COA reflecting the move of the fence and the installation <br />of a new privacy fence be approved. Mrs. Hostetler seconded the moti..(m� No further <br />discussion. <br />
