Hours. The Towing Company shall maintain and Post minimum business hours
<br />stored vehicles as follows: for the release of
<br />a) Monday through Friday., from 9:00 AM to 5:00 PM; and
<br />b) Saturdays, fil'oni 8:00 AM to 12:00 PM.
<br />The Towing Company shall also provide off -hour vehicle Pickup but may charge those wishing to
<br />use such service a reasonable fee for same.
<br />8) Inspection. If Code Enforcement desires to inspect any Vehicle in possession of tile Towing
<br />Company because Of IfieTowing Service, the Towing Company shall Provide Code En-forcem
<br />immediate access to said vehicle'' ent
<br />9) Assignment. Towing Company shall not assign its rights under this contract to any other person
<br />Or entity without the prior written consent of Code Enforcement. Any such assignment without
<br />prior Consent of Code Enforcement shall be void and the attempted assigarnentshall constitute a
<br />material breach ofcontract
<br />10) Records. Tile Towing Company shall always maintain separate and adequate records in
<br />cOntlecti011 with the Towill'
<br />9 Service it Provides to Code Enforcenlent and shall make such records
<br />available to Code Enforcement upon request.
<br />Records to be maintained shall include the following:
<br />a) Time, date, location Of tow, and Code Enforcement inspector authorizing tow;
<br />b) Make, model, vehicle license registration and
<br />C) Iteinized billing of basic tow charge, number ortowed vehicles;
<br />charges; special charges, storage charges and any vehicle repair
<br />d) Signed release form completed by the owner of the vehicle;
<br />e) Sales certificates and bills of sale
<br />f) Complaint form for vehicle owner reporting any complaints about charges, additiona
<br />damage, lost or stolenitems or Other related problems. Cl vellicle
<br />Complaint Form shall be posted in
<br />main Office Of tile Towing, Company. Completed complaint forms will be mailed to Code
<br />Enforcement within five (5) business days of tile complaint.
<br />11 1) Risk. "lowing Company assurnes all risk in the event ofdame ge, theft, fire, Or otherwise, the
<br />vehicles Or any other Property towed, impounded, or stored by owing Company, its emploof yees or
<br />agents. Notwithstanding any other term or condition herein, ill responding to a call fl-oill Code
<br />Enforcement, Towing Company shall have no clain,
<br />officers, employces whatsoever against the city, it's departments,
<br />eillployees or agents or agents or any right to recover from the City,, it's departments office.

<br />or stored for payment of costs and the services provided by the Towing Company, Towing
<br />Company shall assume the entire risk of nonpayment of any service charges incurred pursuallt to
<br />this Contract.
<br />,12) Indemnity. The Towing Company shall indemnify and hold harmless the City, its Code
<br />Enforcenient inspectors, and its employees, including any agency, department, or commission of
<br />the City (collectively, "Indemnitees-) for any and all suits or actions brought against the
<br />hideninitees on account of any loss, injury, or dama
<br />b ge sustained Or clai'lled to have been sustained:
