Third party reports that an employee is impaired in his duties due to the use of <br />prohibited drugs and/or alcohol shall not constitute reasonable cause, but may be <br />cause for the observation of the employee. <br />In any reasonable cause circumstance, the employee to be tested will be <br />transported to an appropriate collection site facility. The employee will then be <br />transported back to the company premises, where a spouse, family member or <br />other individual will be contacted to transport the employee to his/her home. In <br />the event no such individual is available, the company will contact a taxi to <br />transport the employee home or be transported by a company supervisor. If the <br />employee refuses to agree to any of these procedures and attempts to operate <br />his/her own vehicle, the company will make appropriate efforts to discourage the <br />employee from doing so, up to and including contacting local law enforcement <br />officials. Any employee failing to cooperate with any of these procedures <br />described above will be subject to disciplinary action, up to and including <br />termination of employment. <br />While waiting for an employee's drug and/or alcohol test results, that employee <br />must be removed from his/her position until the drug and/or alcohol test results <br />are confirmed negative for prohibited drugs. <br />If the employee tests positive, his/her discipline will be handled according to <br />Section VIII.B. Entitled "Reasonable Cause". <br />If the employee tests negative, the employee may return to work at the company's <br />discretion. <br />E. Return -to -Du Testing <br />An employee who refuses to take a drug and/or alcohol test (considered as a <br />positive test result) or who does not pass a drug and/or alcohol test may not return <br />to duty until he/she passes a return to duty drug and/or alcohol test. An employee <br />who returns to duty after a positive test will be subject to a reasonable program of <br />follow-up drug and/or alcohol testing without prior notice for up to 60 months. <br />See Section VIII. E. entitled "Return to Duty and Follow -Up". <br />F. Refusal to Submit/Insubordination <br />Any employee who refuses to submit to any drug and/or alcohol test required <br />under this Plan will be treated as if he/she had tested positive in any such test. <br />The employee's discipline will be handled according to Section VIII.F entitled <br />"Refusal to Submit/Insubordination". <br />Refusal to submit shall include: 1) failure of employee to report to collection site <br />Aegion - Substance Abuse Policy & Procedures 11 <br />
