must successfully pass a pre -employment drug and alcohol test prior to working in <br />a position for the company and are covered by this Policy. All applicants will be <br />notified, at the time they complete a job application, that they will be required to <br />submit to a drug and alcohol test if they are considered otherwise qualified for <br />employment and that they will be subject to the terms and conditions of this <br />Policy if they are ultimately hired. <br />No applicant will be hired into a position unless he/she passes a pre -employment <br />drug and alcohol test (see Section VIII., A. entitled "Pre -employment"). In the <br />event of a Positive Pre -Employment Test Result the applicant will not be considered <br />for employment presently or for a period of one year following the confirmed <br />positive. Re -testing for pre -employment due to a Positive Result is prohibited. <br />B. Post -Accident <br />All reasonable steps will be taken to obtain a urine and/or breath specimen from <br />an employee after an accident. A drug test must be administered within 32 hours <br />and an alcohol test must be administered within 8 hours. In the case of a <br />conscious but hospitalized employee, the Company will request that the hospital <br />or medical facility perform a post -accident test, following proper chain -of - <br />custody. <br />Employees must refrain from using alcohol for eight hours following an accident <br />unless the employee has already been alcohol tested. <br />If an employee who is subject to post -accident testing is conscious, able to urinate <br />normally (in the opinion of a medical professional) and refuses to be tested, that <br />employee shall be removed from his/her position and shall be subject to discipline <br />according to Section VIII. C. entitled "Post -Accident". <br />Typically, while waiting for an employee's drug and/or alcohol test results, that <br />employee will be removed from all safety sensitive functions, until the drug <br />and/or alcohol test results are confirmed negative for prohibited drugs or alcohol. <br />If the employee's test result is negative, the employee may return to work at the <br />discretion of the Company. <br />"Post -Accident Test" means a test for banned, illegal, unauthorized, illicit Drugs, <br />Controlled Substances and/or Alcohol administered to a Company employee <br />following a work injury or vehicular incident. <br />For purposes of this Policy, an accident is defined as: <br />i.
