REGULAR MEETING N0VLN4BERjj 20j8 354 <br />stated Community Investment recommends approval of the vacation with notification to the <br />petitioner that the vacated condition will result in a split of the 14' right-of-way with the <br />petitioner acquiring only half, a space that may not be sufficient for driveway access or vehicle <br />parking, the reason for the vacation request. The Board recommended that the petitioner be <br />notified that they will need a Cross Access Agreement with their neighbors to use the vacated <br />alley for a driveway. Therefore, Ms. Maradik made a motion recommending approval of the <br />request for vacation. Ms. Dorau seconded the motion which carried. <br />APPROVE TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Maradik, seconded by Ms. Dorau and carried, the following traffic <br />control device requests were approved: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATIONS: 842 S. Albert Ave, <br />1711 Kendall St. <br />REMARKS: All criteria has been met <br />DENY TRAFFIC CONTROL DEVICE <br />Upon a motion made by Ms. Maradik, seconded by Ms. Duran and carried, the following traffic <br />control device request was denied: <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATION: 3619 Pleasant St. <br />REMARKS: All criteria has not been met <br />APPROVE CONSENTS TO ANNEXATION AND WAIVER OF RIGHTS TO <br />REMONSTRATE <br />Mr. Gilot stated that the Board is in receipt of the following Consents to Annexation and <br />Waivers of Right to Remonstrate. The Consents indicate that in consideration for permission to <br />tap into public water/sarritary sewer system of the City, to provide water/sanitary sewer service <br />to the below referenced properties, the applicants waive and release any and all rights to <br />remonstrate against or oppose any pending or future annexations of the properties by the City of <br />South Bend: <br />A. William and Mary Kotinek, 19170 Stone Ridge Drive, South Bend, IN 46637 <br />1. 51648 Audubon Woods Drive— Water (Key No, 002-1003-005747) <br />B. Allen Edwin Homes, 2186 E. Centre Avenue, Portage, MI 49002 <br />1. 53127 Flowing Stream Court — Water/Sewer (Key No. 021-1037-059157) <br />Upon a motion by Ms. Maradik, seconded by Ms. Dorau and carried, the Consents to Annexation <br />and Waivers of Right to Remonstrate were approved as submitted, <br />RATIFY APPROVAT. AVID/OR PUT EASE CONTRACTOR, <br />'rNXT-rn A I- FOR, EXCAVATION, AND <br />UU,JJPANC Y BONDS <br />Ms. Donna Hanson, Division of Engineering, recommended that the following bonds be ratified <br />rsuant to Resolution 100-2000 and/or released as follows t <br />Business <br />Bond Type <br />Approved/ Released <br />Effective Date <br />Larson -Danielson Construction Co,, Inc <br />Contractor <br />Approved <br />October 29, 2018 <br />M&J Concrete <br />Contractor <br />October 10, 2018 <br />Beach House LLC <br />Excavation <br />_Approved <br />Apmoved <br />October 25, 2018 <br />Braille Corn an T T C' <br />Approved <br />October 2, 2018 <br />Sam Mar Tree <br />OccManc <br />y <br />�X roved <br />— <br />September 18, 2018 <br />Ms. Maradik made a motion that the bond's approval and/or release as outlined above be ratified. <br />Ms. Dorau seconded the motion, which carried. <br />APPROVE CLAIMS <br />Ms. Maradik stated that request to pay the following claims in the amounts indicated has been <br />received by the Board; each claim is fully supported by an invoice; the person receiving the <br />goods or services has approved the claims; and the claims have been filed with the City Fiscal <br />Officer and certified for accuracy. <br />
