<br />five (5) inch Portland. Cement Conc-e+ ^ i;, r�+? F, rr ,r with 'Brick la:id on 'a six (6)
<br />inch roiled `gravel foundation, or by 'constructing a Portland Cement Concrete Pavement :
<br />Seven (7) 'inches in depth; by placing the necessay marginal cement curb; by placing
<br />all manholes and inlets to the, -proper trade; end the construction of the necessary
<br />storm Water inlets and conduits; all as shown on the plans and in accordance with the
<br />Iro fi le s, detail drawings and spe ci fi cations on file in tne Oa'fi ce of the Department
<br />of Public Works of the City of Sout.n Bend, Indiana.
<br />The cost of. the Amprovement herein provided for, except street and
<br />alley intersections, shall be pe id by pecial assessment to be levied upon the property
<br />specially benefitted, to the amount that the same may belegally assessed therefor,
<br />in accordance with qn Act =of the General Assembly of the State of Indiana, entitled
<br />An Act Concerning Municipal Corporations," a,_)proved March 6,1905, in accordance with
<br />and pursuant to the provisions of all acts amendatory and supplemental thereto.
<br />The cost of all street and alley intersections, including, one--:
<br />half of file width of t:.e imp rove*gent oppos-_te st.r, and -alleys which � U-ri 3_ o, but
<br />do. not cross said roe c37"T,;y 'er lip proposed to -be improved and that portion. f such
<br />street or alley abutting upon. the . property be l.on;ing to s id City, or upon property
<br />not subject to ueh assessment, shall be paid by t,e City in cash out of its general
<br />"und, if able to do so, or from a fund er, a.ted by a special assessment to be elvied
<br />under the provisions of Section 109 of the above entitled Act.
<br />Assessments of ten dollars and more against each lot, if deferred,
<br />are to be pid in ten equal annual installments with interest at the rate of Six per
<br />oent per annurie A bond or bonds,.rill be issued to the contractor to the amount of such
<br />deferred assessments in pro rata payment for such improvement.
<br />Under no circumstances shall the City of South Bend be, or be
<br />held responsible for any sum or -sums due from said property owner or woners for said
<br />work, or for the collection of the same, or for the payment of any bond, bonds, certi-
<br />ficate or certificates,, is ued to said cont.ractor in payment for such.workg except for
<br />such moneys as shall have actually been received by the City from the assessmi ents for
<br />such improvement, or such moneys a.s said City is by said entiTled Act and manedme-,.ts
<br />and supplements the ret o required to pay. All proceedings had, _nd work done in the
<br />making of said improvement, asse sment of property, collection of assessments and
<br />issuance of bonds therefor, shall be provided for in said above entitled Act, and Acts
<br />amendatory thereof and supplemental thereto.
<br />Be It Farther Resolved, That the Board of Public Works fix the
<br />llth. day of July 1916 at the hur of 7:45 P.A. at the office of the Board of Public
<br />Works,, of this City, as the time and place for the public c ons ide ration' of said
<br />proposed improvement, at which said Board of Public Workswill hear all persons
<br />interested, or whose property is liable to be assessed fro said improverent, and will
<br />decide whether the benefits to the property liable to be assessed for s id improvement
<br />will equal the estimated cost thereof.
