Resibfved by the Board of Public Works of the Citu of South Bend, County of St. Joseph, State of Indiana, That the construction of a. loc 1 sewer, intended and adapted only for local use by�ithe property holders whose property hbuts thereon, a.nd not intended or adapted for receiving; sewerage from collateral drains, be and the sane is, hereby ordered in and a lon..Q Orchard Street from Scott Street to the alley west of Monson Street and Kendall Street from. -Dunham, Street to alley north of Orchard. Street as follows, to -wit: -- Beginning at the intersection of the center line of Scott Street and Orchard Street; thence west along the center line of Orchard Street to the alley west of Monson Street with a 12. inch vitrified pipe serer. Also beginning at the intersection of the center line of Orchard Street and Kendall Street; thence south along the center line of Kendall Street to a point 100 feet -north of the no--th line of Dunham Street with a 12 inch vit -ified pipe sewer. Also beginning at the intersection of the center line of Orchard Street and Kendall Street;thence nrth along the center li'lie of Kendall Street to a point 17 feet south of the south line of the alley north of Orchard Street with a 10 inch vitrified pipe -ewer. A bond or bonds shell be issued to the contractor in payment n for such wrork, unless the property owners pay said assessments before said. Bond or bonds are issued. Under no circumstances shall tl* City of South Bend be or be held responsible for any sum or sums due from said property owner or owners for said work, or for the collection of same, or for the payment of any bond or bondsv certificate )r certificates' issued to said contractor in payment Bor such work, ex cept .for such moneys as shall have been actually received.by the City from the assessments for such improvements, or for such moneys as said City is by said above entitled Act required to pay. All proceedings had and work done in the making of said Improverient, assess ent of property, collections of assessments and issuance Of bonds therefor, shall be as provided for in said above entitled Act.
