W.BER Resolved by the Board of Public Work of the City of South Bend, St. Joseph County, State of Indiana, That it is deemed necessary to improve the `pest side of Oaklad Street from Mishawaka Avenue to Ruskin Street as follows, to —wit:- By constructing a cement sidutalk five (5( feet in width on the west side of said Oakland: Street from Mishawaka. Av -nue to Ruskin Street. All as shown or_ the pans, "-nd in accordance with the profiles and detail drawingsl�uddsppebfficutions on file in tue off'ic of the De— partment of Public Works of the City of South Bend, Indiana, in accordance. with the profile, deta.ils, drawings and specifications on file in the office ,or the Department of the Board of Public Works of said City; and such improvement is now ordered. The cbst of said improvement, including the cost of street and alley -intersections, shall be assessed. upon the real estate abutting on said west side of Oakland Street all according; to the method and mariner provided for in an Act of the General Assembly of the State of Indiana, entitled " An Act Concerning Municipal Corporations," approved March 6,1905, and in accordance with and pursuant to tiie provisions of all amendatory acid supplemental acts thereto, passed by the General Assembly of the State of Indiana. Assessments, if deferred,. are to be paid in ten equal annual installments, with interest at the rate of Six per cent per annum. A bond or bonds shall be issued to the contractor in payment of such work, unless the pro— perty owners pay said assessment before said bond or bonds are issued. Under no cir— cumstances shall the City of.South Bend, be, or be held responsible for any sum or sums, due from said property owner or owners for said work, or for the collection of the same, or for the payment of .any bond, bonds, certificate or certificates, issued to said con— tractors in -payment for such work, except for such moneys as shall have been actually received by the City from the assessments for such improvement, or such moneys as said City is by said above entitled.
