Section 7.05 EXCLUSIVE BROADCAST RIGHTS. The Team shall have the <br />exclusive right to broadcast, televise, cablecast and webcast all Team Events and Team Special <br />Events held in the Stadium during the term of this Stadium Agreement. <br />ARTICLE VIII <br />COMPENSATION PAYABLE BY THE TEAM TO THE PARK BOARD <br />Section 8.01 AMOUNT OF COMPENSATION PAYABLE. In consideration of the <br />use of the Stadium by the Team as provided herein, and the granting of the exclusive food, <br />beverage, souvenir, Upper Deck, and novelty franchise, as provided for in Section 6.01 herein, <br />the Team, shall pay to the Park Board the following payments during the term of this Stadium <br />Agreement: <br />The Team will pay the Park Board annually throughout the Term the sum of Seventy <br />Five Thousand Dollars ($75,000) in five (5) equal installments of Fifteen Thousand Dollars <br />($15,000) from May 1 through September 1. <br />In addition, the Team will pay the following annually throughout the Term: <br />Per Ticket Amount Actual Turnstyle Attendance <br />$ 0.25 125,000 — 174,999 <br />$ 0.50 175,000 — 199,999 <br />$ 1.00 200,000+ <br />Section 8.02 MAINTENANCE OF BOOKS AND ACCOUNTS. All books, accounts, <br />and records, including all state gross sales tax returns and such other reports that the Team may <br />be required to furnish to any governmental agency, shall be open to the inspection of the Park <br />Board at all reasonable times. Such books and records shall be maintained by the Team for at <br />least a three -year (3) period from the end of the calendar year in which the filing as referred to <br />herein occurred. The Park Board agrees that the purpose of such information shall be to gather <br />information in preparation for renewal of the lease agreement. A Team representative shall meet <br />with the Superintendent of the Park Department monthly during the Baseball Season to discuss <br />matters of mutual interest. <br />Section 8.03. REPORTS. The Team shall report actual attendance at all games at the <br />stadium to the Board at its regularly monthly meetings from May through October. <br />Section 8.04 NO WAIVER OF DEFICIENCY. The acceptance of any amount by the <br />Park Board shall not be construed as an admission of the accuracy of the financial statement or <br />statements filed with such amount or an admission or acceptance of the sufficiency of the <br />amount to comply with the terms of this Stadium Agreement. <br />
