x. Failure to meet compliance schedules; <br />xi. Failure to complete a wastewater discharge survey or the wastewater discharge permit <br />application; <br />xii. Failure to provide advance notice of the transfer of business ownership of a permitted facility; <br />or <br />xiii. Violation of any Pretreatment Standard or Requirement, or any terms of this permit or Chapter <br />17 of the City of South Bend's Municipal Code. <br />10. Confidentiality <br />a. Information and data on a permittee obtained from reports, surveys, wastewater discharge permit <br />applications, individual wastewater discharge permits and monitoring programs, and from the <br />Director's inspection and sampling activities, shall be available to the public without restriction, <br />unless the permittee specifically requests, and demonstrates, to the satisfaction of the Director, <br />that the release of such information would divulge information, processes, or methods of <br />production entitled to protection as trade secrets under the Indiana Access to Public Records Act <br />(IC 5-14-3-4(A)(4)). Any such request must be asserted at the time of submission of the <br />information or data by stamping the words "confidential business information" on each page <br />containing such information. When requested and demonstrated by the permittee furnishing a <br />report that such information should be held confidential, the portions of a report which might <br />disclose trade secrets or secret processes shall not be made available for inspection by the public, <br />but shall be made available immediately upon request to governmental agencies for uses related <br />to the NPDES program or pretreatment program, and in enforcement proceedings involving the <br />person furnishing the report. <br />b. Wastewater constituents and characteristics and other effluent data, as defined at 40 CFR 2.302 <br />shall not be recognized as confidential information and shall be available to the public without <br />restriction. <br />c. All other information which is submitted to the State or Board of Public Works shall be available <br />to the public at least to the extent provided by 40 CFR 2.302. <br />11. Transfer of Ownership or Control <br />a. This permit may be transferred to a new owner or operator only if the permittee gives at least <br />thirty (30) days advance notice to the Director and the Director approves the individual <br />wastewater discharge permit transfer. The notice to the Director must include a written <br />certification by the new owner or operator which: <br />L Identifies the new owner or operator, including address and telephone number; <br />ii. Identifies the Authorized Representative for the new owner or operator in accordance with Part <br />IV (B)(1 S) of this permit, including telephone number and email address; <br />iii. States that the new owner and/or operator has no immediate intent to change the facility's <br />operations and processes; <br />iv. Identifies the specific date on wbich the transfer is to occur; and <br />v. Acknowledges full responsibility for complying with the existing individual wastewater <br />discharge permit. <br />
