x. Failure to meet compliance schedules; xi. Failure to complete a wastewater discharge survey or the wastewater discharge permit application; xii. Failure to provide advance notice of the transfer of business ownership of a permitted facility; or xiii. Violation of any Pretreatment Standard or Requirement, or any terms of this permit or Chapter 17 of the City of South Bend's Municipal Code. 10. Confidentiality a. Information and data on a permittee obtained from reports, surveys, wastewater discharge permit applications, individual wastewater discharge permits and monitoring programs, and from the Director's inspection and sampling activities, shall be available to the public without restriction, unless the permittee specifically requests, and demonstrates, to the satisfaction of the Director, that the release of such information would divulge information, processes, or methods of production entitled to protection as trade secrets under the Indiana Access to Public Records Act (IC 5-14-3-4(A)(4)). Any such request must be asserted at the time of submission of the information or data by stamping the words "confidential business information" on each page containing such information. When requested and demonstrated by the permittee furnishing a report that such information should be held confidential, the portions of a report which might disclose trade secrets or secret processes shall not be made available for inspection by the public, but shall be made available immediately upon request to governmental agencies for uses related to the NPDES program or pretreatment program, and in enforcement proceedings involving the person furnishing the report. b. Wastewater constituents and characteristics and other effluent data, as defined at 40 CFR 2.302 shall not be recognized as confidential information and shall be available to the public without restriction. c. All other information which is submitted to the State or Board of Public Works shall be available to the public at least to the extent provided by 40 CFR 2.302. 11. Transfer of Ownership or Control a. This permit may be transferred to a new owner or operator only if the permittee gives at least thirty (30) days advance notice to the Director and the Director approves the individual wastewater discharge permit transfer. The notice to the Director must include a written certification by the new owner or operator which: L Identifies the new owner or operator, including address and telephone number; ii. Identifies the Authorized Representative for the new owner or operator in accordance with Part IV (B)(1 S) of this permit, including telephone number and email address; iii. States that the new owner and/or operator has no immediate intent to change the facility's operations and processes; iv. Identifies the specific date on wbich the transfer is to occur; and v. Acknowledges full responsibility for complying with the existing individual wastewater discharge permit.
