b. Failure to provide advance notice of a transfer renders this permit void as of the date of transfer. <br />12. Reopening Clause <br />a. This permit shall be modified, or alternatively, revoked and reissued, to comply with any <br />applicable effluent limitation or standard issued or approved under section 307(b) of the Clean <br />Water Act if the effluent limitation or standard so issued or approved: <br />i. Contains different conditions or is otherwise more stringent than any effluent limitation in the <br />permit; or <br />ii. Controls any pollutant not limited in the permit. <br />b. The permit, as modified or reissued under this paragraph, shall also contain any other <br />requirements of the Clean Water Act when applicable. <br />13. Records Retention <br />a. Permittee's shall retain, and make available for inspection and copying, all records of information <br />obtained pursuant to any monitoring activities required by this permit, any additional records of <br />information obtained pursuant to monitoring activities undertaken by the permittee independent <br />of such requirements, and documentation associated with Best Management Practices established <br />under Section 17-5 of the South Bend Municipal Code. Records shall include the date, exact place, <br />method, and time of sampling, and the name of the person(s) taking the samples; the dates <br />analyses were performed; who performed the analyses; the analytical techniques or methods used; <br />any information used to demonstrate that the analysis was performed in accordance with methods <br />approved in 40 CFR Part 136; and the results of such analyses. These records shall remain <br />available for a period of at least three (3) years. This period shall be automatically extended for <br />the duration of any litigation concerning the permittee or the City, or where the permittee has been <br />specifically notified of a longer retention period by the Director. <br />14. Federal and State Pretreatment Requirements <br />a. Compliance with this wastewater discharge permit does not relieve the permittee of responsibility <br />for compliance with all applicable Federal and State Pretreatment Standards, including those <br />which become effective during the term of this wastewater discharge permit. <br />15. Authorized Representatives <br />a. The permittee shall be represented by an Authorized Representative and/or Duly Authorized <br />Representative. <br />i. The Authorized Representative or Duly Authorized Representative of the permittee shall be: <br />a. If the Permittee is a corporation: <br />i. The president, secretary, treasurer, or a vice-president of the corporation in charge of a principal <br />business function, or any other person who performs similar policy or decision -making functions <br />for the corporation; or <br />
