<br />Also present was Edward Gray, 645 First Bank Building, South Bend, Indiana,
<br />attorney for Schillings, 329 S. Lafayette Boulevard; and other interested
<br />parties.
<br />After hearing all who wished to speak, either for or against the vacation,
<br />upon motion made, seconded and carried, the matter was taken under advisement
<br />by the Board.
<br />HEARING ON VACATION RESOLUTION NO. 3303- THOMAS L. LADD
<br />This being the date set, hearing was held on Vacation Resolution No. 3303,
<br />being for the vacation of:
<br />The alley between Rockne Drive and MacArthur Avenue, from.
<br />Chimes Boulevard to Pyle Avenue.
<br />The Clerk tendered proofs of publication in the South Bend Tribune and the
<br />Tri County News on September 5 and September 12, 1969, which were read and
<br />found to be proper. No remonstrators having appeared and no written re-
<br />monstrances having been received, upon motion made, seconded and unanimously
<br />carried, the Resolution for said vacation was finally adopted. And the City
<br />Engineer was directed to prepare an Assessment Roll covering the assessment
<br />of benefits and the award of damages to surrounding property owners.
<br />HEARING ON VACATION RESOLUTION NO. 33o4 - O'BRIEN .CORPORATION
<br />Thl heing the date set, hearing was held on Vacation Resolution No, 3304,
<br />tieing for the vacation of:
<br />Brookfield Street, from Washington Street to Orange Street;
<br />and Colfax Street, from Brookfield Street east, to the first
<br />north -south alley east of Brookfield Street.
<br />The Clerk tendered proofs of publication in the South Bend Tribune and the
<br />Tri County News on September 5 and September 12, 1969, which were read and
<br />found to be sufficient.
<br />Mr. Leonard Miller, 221 Devonshire Drive, South Bend, Indiana, representing
<br />O'Brien Paint Company, appeared before the Board.
<br />Also appearing before the Board were attorney Charles Hahn, 231 S. Eddy Street,
<br />Jessee Heggie, 1007 Oakwood, Toledo, Ohio; Joe Harris, 119 N. Jackson Street,
<br />South Bend; William Alexander, 212 N. Johnson Street; L. F. Brown, 1911 Parallel
<br />Street; Beulah Tolbert, 206 N. Brookfield; and Mrs. Jessie McCoy, 208 N. Jackson
<br />Street.
<br />Having heard all who wished to speak, upon motion made, seconded and carried,
<br />the Board took the matter under advisement.
<br />REQUEST OF TERRY NOWICKI TO PARK AT JOHN ADAMS HIGHSCHOOL WHILE SELLING
<br />10E CREAM - DENIED
<br />After due consideration and recommendation of the Traffic Engineer, upon motion
<br />made, seconded and carried, the request of Terry Nowicki for permission to
<br />park his truck in the vicinity of John Adams High School between 11:30 A.M.
<br />and 1:30 P.M. while selling ice cream to students was denied.
<br />REQUEST TO HOLD PARADE - JOHN ADAMS HIGH SCHOOL - 9/16/69
<br />Upon motion made, seconded and unanimously carried, the Board approved the
<br />request of Kathleen L. Gagen, 330 S. Twyckenham, South Bend, Indiana, for
<br />John Adams High School, under the sponsorship of River Park Businessmen's
<br />Association, to hold a homecoming parade on September 19, 1969, commencing
<br />at 4:00 P.M.
<br />ST TO HOLD PARADE - ATHLETIC & CONVOCATION CENTER UNIVERSITY OF
<br />Upon motion made, seconded and unanimously carried, the Board approved the
<br />request of the Athletic and Convocation Center of the University of Notre
<br />Dame, by Joe P. Sassano, Assistant Director, to have an "animal walk';
<br />on September 16, 1969, commencing at approximately 11:30 A.M. in conjunction
<br />with the appearance of the Ringling Brothers Barnum and Bailey Circus.
