<br />And the Board sets October 13, 1969, as the time for receiving and
<br />hearing remonstrances from persons interested in or affected by said
<br />vacation. And the Clerk is directed to publish notice of such hearing,
<br />tigether with the amount of damages awarded and benefits assessed,
<br />in the South Bend Tribune and the Tri County News on September 19,
<br />September 26 and October 3, 1969.
<br />HEARING ON RESOLUTION NO. 3300 - FOR THE OPENING OF FELLOWS STREET
<br />CONTINUED FROM 9/ / 9
<br />The matter of Vacation Resolution No. 3300, being for the opening of
<br />Fellows Street, more particularly described as:
<br />A public street 60 feet in width running north and south
<br />in the northwest Quarter of Section 25, Township 37 north,
<br />Range 2 east, and connecting at both ends with Fellows
<br />Street as presently existing, and constituting an extension
<br />thereof from Walter Street to the north line of the south-
<br />east Quarter of the northwest Quarter of said Section, the
<br />center line of said proposed extension to coincide with the
<br />center line of Fellows Street as presently existing at both
<br />ends.
<br />having been taken under advisement on September 8, 1969, and having been
<br />duly considered, it was moved, seconded and carried that the Resolution
<br />for the opening of Fellows Street be finally adopted. And the City Engineer
<br />C.
<br />was directed to prepare an assessment roll covering the assessment of
<br />benefits and the award of damages to surrounding property owners.
<br />HEARING ON VACATION RESOLUTION NO. 3301 - E. J. BARANY
<br />This being the date set, hearing was held on Vacation Resolution No. 3301,
<br />being for the vacation of:
<br />The first north -south alley west of Main Street, running
<br />from the south line of Indiana Avenue south, to the south
<br />line of the first east -west alley south of Indiana Avenue.
<br />Also, the first east -west alley south of Indiana Avenue
<br />running from the west line of Main Street west, to the
<br />east line of the above mentioned north -south alley.
<br />The Clerk tendered proofs of publication in the South Bend Tribune and
<br />the Tri County News on the 5th and 12th day of September, which were read
<br />and found to be proper.
<br />David M. Barrett, attorney for petitioner, 505 First Bank Building, South
<br />Bend, Indiana, appeared before the Board on behalf of the petitioner. No
<br />other persons appeared for or against the vacation.
<br />Upon motion made, seconded and unanimously carried, the matter was continued
<br />to permit the petitioner time in which to present to the Board agreements
<br />from Penn Central Railroad and Wells Manufacturing Company that they have
<br />no objection to the said vacation, as recommended by the Area Plan Commission.

<br />This being the date set, hearing was held on Vacation Resolution\No. 3302
<br />being for the vacation of:
<br />Franklin Street, from Western Avenue to Wayne Street.
<br />The Clerk tendered proofs of publication in the South Bend Tribune and the
<br />Tri County News on September 5 and September 12, 1969,t 1which were read and
<br />found to be sufficient.
<br />Appearing before the Board were Van Gates, President of Gates Chevrolet
<br />Corporation, 333 Western Avenue, South Bend, Indiana, petitioner, and
<br />William Farabaugh, attorney for petitioner, 316 First Bank Building, South
<br />Bend, Indiana.
<br />Also appearing before the Board were Chalmer Pearson, 214 Brook Street,
<br />Mishawaka, Indiana, Sales Manager for Super Par Oil Company, and John Doran,
<br />725 St. Joseph Bank Building, South Bend, Indiana, attorney for Super Par
<br />Oil Company.
