9/13/71 (4) The east -west alley (between Washington Street and Colfax Avenue) between the west line of Kaley Street and the east line of the first north -south alley west of Kaley Street. Said vacation subject to a 14 foot wide sewer easement between the west line of Kaley Street and the east line of the first north -south alley west of Kaley Street. The Clerk tendered proofs of publication in the South Bend Tribune and the Tri County News on September 3 and September 10, 1971, which were found to be sufficient. William SlabaugW-tappeared on behalf of the Department of Redevelopment. Also appearing was a representative of Indiana and Michigan Electric Company who stated Indiana and Michigan Electric Company has no objection to the vacation since the Resolution reserves the rights of utility easements. No remonstrators appeared and no written remonstrances were received. Upon motion made, seconded and carried,the Resolution as adopted August 30, 1971, was ratified and confirmed and said streets and alleys vacated. The City Engineer is directed to prepare an assessment roll covering the assessment of benefits and the award of damages to surrounding properties. HEARING ON VACATION RESOLUTION NO. 3345 - ROY H. POLLOCK This being the date set, hearing was held on Vacation Resolution No. 3345 for the vacation of; The alley running east from Fellows Street south of Dubai] Avenue and crossing Lots 55 and 56, and a portion of Lot 57; thence running south exiting in the east -west alley between Dubai] Avenue and Dayton Street from Fellows Street to Rush Street in Henry Studebaker's First Addition. The Clerk tendered proofs of publication in the South Bend Tribune and the Tri County News on September 3 and September 10, 1971, which were found to be sufficient. No remonstrators appeared and no written remonstrances were received. Upon motion made, seconded and carried the Resolution as adopted August 30, 1971, was ratified and confirmed and the said alley vacated. HECKAMAN This being the date set, hearing was held on Vacation Resolution No. 3346 for the vacation of; The north and south alley between Carroll and Columbia Streets from the south right of way line of the first alley south of Bronson Street running south 102 feet to the north property line of Lot 29 all in Denniston and Fellows Addition. Attorney Russell C. Kuehl, 606 Tower Building, South Bend, Indiana, appeared on behalf of the petitioners. No remonstrators appeared and no written remonstrances were received. Upon motion made, seconded and unanimously carried, the Resolution was ratified and confirmed as adopted August 30, 1971, and said alley vacated. ENGINEER'S RECOMMENDATION CONTRACT AWARDED TOPICS IMPROVEMENT - TWYCKENHAM DRIVE AND EWING STREET INTERSECTION Clyde E. Williams and Associates, Inc., consulting engineers, having reviewed the bids received September 7, 1971, for the improvement of the intersection at Twyckenham Drive and Ewing Street, recommends the award of contract for such improvement to Rieth Riley Construction Company, Inc., on its low bid of $17,56o.4o. 1
