9/13/71 <br />(4) The east -west alley (between Washington Street and Colfax <br />Avenue) between the west line of Kaley Street and the east <br />line of the first north -south alley west of Kaley Street. <br />Said vacation subject to a 14 foot wide sewer easement <br />between the west line of Kaley Street and the east line of <br />the first north -south alley west of Kaley Street. <br />The Clerk tendered proofs of publication in the South Bend Tribune and the <br />Tri County News on September 3 and September 10, 1971, which were found to <br />be sufficient. <br />William SlabaugW-tappeared on behalf of the Department of Redevelopment. <br />Also appearing was a representative of Indiana and Michigan Electric Company <br />who stated Indiana and Michigan Electric Company has no objection to the <br />vacation since the Resolution reserves the rights of utility easements. No <br />remonstrators appeared and no written remonstrances were received. Upon <br />motion made, seconded and carried,the Resolution as adopted August 30, 1971, <br />was ratified and confirmed and said streets and alleys vacated. <br />The City Engineer is directed to prepare an assessment roll covering the <br />assessment of benefits and the award of damages to surrounding properties. <br />HEARING ON VACATION RESOLUTION NO. 3345 - ROY H. POLLOCK <br />This being the date set, hearing was held on Vacation Resolution No. 3345 <br />for the vacation of; <br />The alley running east from Fellows Street south of <br />Dubai] Avenue and crossing Lots 55 and 56, and a portion <br />of Lot 57; thence running south exiting in the east -west <br />alley between Dubai] Avenue and Dayton Street from <br />Fellows Street to Rush Street in Henry Studebaker's <br />First Addition. <br />The Clerk tendered proofs of publication in the South Bend Tribune and the <br />Tri County News on September 3 and September 10, 1971, which were found to <br />be sufficient. Kuehl, 606 Tower Building, South Bend, Indiana, appeared <br />on behalf of the petitioners. No remonstrators appeared and no written <br />remonstrances were received. Upon motion made, seconded and unanimously <br />carried, the Resolution was ratified and confirmed as adopted August 30, <br />1971, and said alley vacated. <br />The City Engineer is directed to prepare an assessment roll covering the <br />assessment of benefits and the award of damages to the surrounding properties. <br />ENGINEER'S RECOMMENDATION <br />CONTRACT AWARDED <br />TOPICS IMPROVEMENT - TWYCKENHAM DRIVE AND EWING STREET INTERSECTION <br />Clyde E. Williams and Associates, Inc., consulting engineers, having reviewed <br />the bids received September 7, 1971, for the improvement of the intersection <br />at Twyckenham Drive and Ewing Street, recommends the award of contract for <br />such improvement to Rieth Riley Construction Company, Inc., on its low bid of <br />$17,56o.4o. <br />1 <br />
