1. TERM OF CONTRACT <br />a. Effective date: This Contract shall take effect on January 1, 2017. If <br />the Contract has not been approved by the Attorney General by that <br />time, then the Contract shall take effect on the first day of the month <br />that is at least thirty (30) days after the Contract is approved by the <br />Attorney General, or an authorized representative. <br />b. Termination date is the earliest of: <br />1. This Contract shall terminate on the date a lack of funding <br />determination is made by the State Budget Director as provided in <br />Section 19 of this Contract. <br />2. If the State determines there has been an ethics violation, this <br />Contract shall terminate on the date notice is given to the CITY as <br />provided in Section 16 of this Contract. <br />3. This Contract for maintenance of traffic signals shall be for a term <br />of four (4) years. If renegotiations of a new Contract are not <br />completed by the expiration date of the Contract, this Contract may <br />continue in force at the current rates, by mutual written consent of <br />both parties until a new Contract is signed and approved. <br />4. This Contract may be terminated by either party on the one (1), two <br />(2), or three (3) year anniversary of the Effective date described <br />in Section l.a., provided that the party seeking to terminate gives <br />at least forty-five (45) days notice. <br />2. PRE -CONSTRUCTION MEETING <br />Prior to the first work performed under terms of this Contract, the CITY <br />shall schedule a Pre -construction Meeting at a time and place convenient <br />to the INDOT La Porte District Traffic Engineer (the DTE) . If the CITY <br />intends to utilize a Contractor for portions of the work, representatives <br />of the Contractor shall attend the meeting. INDOT will provide the CITY <br />with the names and telephone numbers (or other electronic means of <br />contact) of INDOT personnel that may be contacted. At the pre - <br />construction meeting the CITY shall submit to the Engineer, as follows: <br />a. Schedule of operations for review and approval. This schedule shall <br />consist of the hours of work for a normal work day. <br />b. The method or handling, transportation, and storage of the INDOT <br />materials. <br />C. List of the traffic signal technicians with copies of Level II Traffic <br />Signal Technician certificates and resumes detailing the work histories <br />of the technicians.
