signals which are to be installed by private owners on state .roads by <br />agreement with INDOT shall be submitted to the CITY for their <br />information prior to INDOT granting permission for such installation. <br />c. INDOT shall coordinate the design of new signals or the modernization <br />of existing signals on State roads with the CITY to insure that they <br />are compatible with the CITY'S Traffic Control System. <br />d. The CITY shall be allowed to attend the final inspection of newly <br />installed or modernized traffic signals for which the CITY shall <br />provide maintenance under this Contract. <br />e. The CITY shall accept a new signal installation for maintenance after <br />INDOT has furnished the CITY a copy of its Form I.C. 63GA (Completion <br />Report) for installation and a copy of the executed Form T-38a (Change <br />Order for Signal Maintenance Contract) indicating that the new signal <br />is installed in accordance with the current INDOT Standard <br />Specifications and is approved as an addition to this Contract. Said <br />additions to the Contract must be approved by the "CITY's Board of <br />Public Works", prior to acceptance. <br />14. RIGHTS AND RESERVATIONS <br />a. INDOT reserves the right to enter at anytime onto any signalized <br />intersection covered under this Contract listed in Exhibit "A" or <br />into any controller cabinet for inspection, alteration or change to <br />affect emergency repairs, modifications or to correct malfunctions. <br />b. No change, which will alter its design, phasing or functional <br />operations, will be madeto any traffic signal without authorization <br />from INDOT La Porte District Traffic Engineer. <br />c. In the event that INDOT awards a separate Contract to modernize, <br />modify, rebuild or remove any signal installation covered under this <br />Contract, INDOT reserves the right to determine whether its <br />Contractor or the CITY will be responsible for the maintenance of <br />the existing and/or temporary signal installation during the term of <br />the modernization or modification Contract.. <br />d. INDOT reserves the right to inspect stockpiled INDOT furnished <br />signal equipment being stored by the CITY (or its Contractor) with <br />two (2) days written notice supplied to the CITY by INDOT. <br />e. The CITY shall maintain existing signalized intersection(s) and <br />equipment as long as they are in service, unless otherwise directed. <br />The CITY shall assume maintenance of new signalized intersections(s) <br />and equipment when notified by INDOT.
