may be communicated verbally by INDOT. INDOT, within five (5) <br />working days of the verbal order, will provide a follow up letter by <br />fax, email or mail. <br />15. INSURANCE <br />a. The CITY and/or its Contractor shall carry protective liability <br />insurance coverage for all work covered under this Traffic Signal <br />Maintenance Contract. The insurer shall be a company holding a <br />certificate of authority issued by the Indiana state Insurance <br />Commissioner to do business in the State. Prior to commencing work <br />under this Contract, the CITY or its Contractor shall file with <br />INDOT a certificate of insurance on an acceptable form, which shall <br />serve as evidence that the CITY or its Contractor has obtained <br />insurance in accordance with the following requirements and minimum <br />limits of coverage. <br />i. A limit of not less than $100,000.00 for all damages arising <br />out of bodily injury or death in any one occurrence. <br />ii. A limit of not less than $100,000.00 for all damages, arising <br />out of an injury to or destruction of property in an <br />occurrence, an aggregate limit of not less than $300,000.00 <br />for all damages arising out of injury or destruction of <br />property during thepolicy period. <br />b. such insurance shall hold harmless and indemnify INDOT from, for and <br />against any claim of any person in tort, Contract, or otherwise <br />arising out of the acts or omissions of the CITY in the execution <br />and implementation of the traffic signal maintenance (routine and/or <br />emergency) in compliance with the stipulations of this Contract. <br />c. If the CITY is self -insured under the provisions of Indiana law, the <br />CITY shall provide protection for public liability and physical <br />damage arising from the performance of its obligations under this <br />Contract in amounts not less than those stated in A. and B. above. <br />In order to hold harmless and indemnify INDOT, the CITY will at its <br />sole cost and expense keep such self-insurance in full force and <br />effect during the term of this Contract or will, at its option, <br />provide equivalent insurance with a responsible carrier as stated <br />above. <br />d. Unless otherwise directed by INDOT, it shall be the responsibility <br />of the CITY to maintain the old signals and its related equipment as <br />long as they remain in service and to assume maintenance of the new <br />Page 16 of 53 Pages <br />
