REGULAR MEETING <br />AUGUST 5, 1986 <br />In response to a question by Ms. Barnard regarding whether the <br />location of the parking lot would be to the north of the proposed <br />alley to be vacated, Mr. Bonewitz stated that she was correct. <br />Therefore, upon a motion made by Mr. Vance, seconded by Ms. <br />Barnard and carried, the two (2) Dedications of right-of-way were <br />accepted for filing and the Clerk was instructed to forward to <br />the Common Council a favorable recommendation on the above <br />referred to alley vacation subject to any and all utility <br />easements. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATION: E/ <br />ALLEY EXCEPTING THE THRU N/S RIGHT-OF-WAY BOUNDED BY MICHIGAN <br />STREET ON THE E., MAIN ST. ON THE W., LOTS 297 & 304 ON THE NO <br />AND LOTS 298 & 303 ON THE SO. <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />the east/west alley excepting the thru north/south right-of-way <br />bounded by Michigan Street on the east, Main Street on the west, <br />abutting Lots 297 and 304 of part of the Original Plat of South <br />Bend on the north, and abutting Lots 298 and 303 of part of the <br />Original Plat of South Bend on the south, all in the City of <br />South Bend, Portage Township, St. Joseph County, Indiana. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by the South Bend <br />Redevelopment Commission, 1200 County -City Building, South Bend, <br />Indiana and the South Bend Public Library, Board of Trustees, 122 <br />West Wayne Street, South Bend, Indiana. It was further noted <br />that pursuant to South Bend Municipal Code Section 18-53.8, <br />owners whose property abut the proposed alley to be vacated were <br />notified of the Board's Public Hearing date. <br />Mr. Robert Parker, President, Library Board of Trustees, 205 West <br />Jefferson Boulevard, South Bend, Indiana, was present and <br />addressed the Board. Mr. Parker stated that the South Bend <br />Public Library is listed as a joint Petitioner in the proposed <br />alley vacation and is particularly interested in the vacation of <br />the west half of the alley with the Redevelopment Commission <br />primarily interested in the vacation of the east half of the <br />alley. <br />Mr. Parker stated that the library owns the real estate on both <br />sides of the alley to be vacated and wishes to vacate the alley <br />in conjunction with library expansion plans currently underway. <br />Ms. Ann Kolata, Deputy Executive Director, Department of Economic <br />Development, addressed the Board on behalf of the South Bend <br />Redevelopment Commission. Ms. Kolata stated that the Commission <br />is primarily interested in the vacation of the east half of the <br />alley and owns property on both sides. The vacation of the alley <br />would assist the Commission in consolidating all of the vacant <br />property in the area in order that it can be offered for sale for <br />commercial development. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Ms. Barnard and carried, the Public <br />Hearing on this matter was closed. <br />There being no questions by members of the Board, upon a motion <br />made by Ms. Barnard, seconded by Mr. Vance and carried, the Clerk <br />was instructed to forward to the Common Council a favorable <br />recommendation on the above referred to alley vacation subject to <br />any and all utility easements. <br />
