REGULAR MEETING AUGUST 5, 1986 <br />In response to Mr. Pocius' statement that the Board has not <br />addressed the issue of stripping security from the block should <br />the alley be vacated, as it would create a high intense <br />commercial use and block access to police and fire services, as a <br />result of the nature of the types of vehicles being stored and <br />obstructing site lines of the properties, Mr. Vance stated that <br />there are a lot of properties within the City that do not have <br />access to alleys and that alleys were not created for security <br />purposes. Mr. Leszczynski and Ms. Barnard stated that it is <br />their opinion that this proposed vacation would increase the <br />security of the properties in the area. <br />Ms. Barnard advised Mr. Gates that there may be some screening <br />requirements and that she would be checking with the Building <br />Commissioner regarding that matter. <br />There being no further questions by members of the Board, upon a <br />motion made by Ms. Barnard, seconded by Mr. Leszczynski and <br />carried, the Clerk was instructed to forward to the Common <br />Council a favorable recommendation on the above referred to alley <br />vacation subject to the dedication of additional right-of-way to <br />assure a safe turn movement for vehicles and subject to any and <br />all utility easements. <br />PUBLIC HEARING AND FAVORABLE RECOMMENDATION - ALLEY VACATION: 1ST <br />E/W ALLEY SO. OF NAVARRE ST. RUNNING WEST FROM MICHIGAN ST. A <br />DISTANCE OF 159 FT. TO A POINT 6 FT. E. OF THE 1ST INTERSECTING <br />N/S ALLEY E. OF MAIN STREET AND FILING OF DEDICATIONS OF PUBLIC <br />RIGHT-OF-WAY <br />Mr. Leszczynski advised that this was the date set for the <br />Board's Public Hearing on a proposed alley vacation described as <br />the 1st east/west alley south of Navarre Street running west from <br />Michigan Street a distance of 159 feet to a point of 6 feet east <br />of the lst intersecting north/south alley east of Main Street, <br />all being in the Original Plat of South Bend, Indiana, and lying <br />between Lots 147 and 148 of said Plat. <br />It was noted that this Public Hearing is being held in order for <br />the Board to submit a recommendation to the Common Council <br />concerning the Vacation Petition filed by Memorial Health <br />Properties, Inc., 425 North Michigan Street, Suite 600, South <br />Bend, Indiana. It was further noted that pursuant to South Bend <br />Municipal Code Section 18-53.8, owners whose property abut the <br />proposed alley to be vacated were notified of the Board's Public <br />Hearing date. <br />Mr. Richard Bonewitz, Attorney At Law, 205 West Jefferson <br />Boulevard, Suite 204, South Bend, Indiana, was present on behalf <br />of the Petitioner, Memorial Health Properties, Inc. <br />Mr. Bonewitz stated that the vacation is required to provide <br />parking for the Memorial Professional building which is <br />immediately to the south of the above referred to alley. <br />Vacation of the alley would provide parking spaces for <br />approximately 25-34 vehicles and it is anticipated that this <br />proposed vacation would benefit traffic congestion. <br />Mr. Bonewitz stated that two (2) Dedications of additional <br />right-of-way have been submitted to provide for a safe turn <br />movement. The dedications are for parcels of land located in the <br />S.W. corner of Lot 147 and the S.E. corner of Lot 154. <br />There being no one else present wishing to speak either for or <br />against the proposed alley vacation, and no written objections <br />having been filed with the Board, upon a motion made by Mr. <br />Leszczynski, seconded by Ms. Barnard and carried, the Public <br />Hearing on this matter was closed. <br />I1 <br />1 <br />
