REGULAR MEETING SEPTEMBER 13,201 293 <br />vacation would not make access to the lands of the aggrieved person by means of public way <br />difficult or inconvenient. The vacation would not hinder the public's access to a church, school <br />or other public building or place. The vacation would not hinder the use of a public right-oGway <br />by the neighborhood in which it is located or to which it is contiguous. Therefore, Mr. Relos <br />made a motion recommending approval of the request for vacation subject to obtaining an <br />easement for and the construction of a chamfer designed by the Engineering Department. Ms. <br />Maradik seconded the motion which carried. <br />UNFAVORABLE RECOMMENDATION - PETITION TO VACATE THE FIRST <br />NORTH/SOUTH ALLEY WEST OF TWYCKFNHAM AND NORTII OF MISHAWAKA <br />AVENUE <br />Mr. Gilot indicated that Tina Thompson, 1437 Mishawaka Avenue, South Bend, Indiana 46615, <br />has submitted a request to vacate the above referenced alley for safety purposes and to fence. <br />Mr. Gilot advised the Board is in receipt of favorable recommendations concerning this Vacation <br />Petition from the Area Plan Commission, Fire Department, and Solid Waste. Engineering and <br />Community Investment give unfavorable recommendations due to hindering access to a garage. <br />Area Plan stated the vacation would not hinder the growth or orderly development of the unit or <br />neighborhood in which it is located or to which it is contiguous. The vacation would not make <br />access to the lands of the aggrieved person by means of public way difficult or inconvenient. <br />The vacation would not hinder the public's access to a church, school or other public building or <br />place. The vacation would not hinder the use of a public right-of-way by the neighborhood in <br />which it is located or to which it is contiguous. Therefore, Ms. Maradik made a motion <br />recommending an unfavorable recommendation of the request for this vacation due to the garage <br />access issue. Mr. Relos seconded the motion which carried. <br />FAVORABLE RECOMMENDATION - PETITION TO VACATE. THE FIRST EAST/WEST <br />ALLEY BETWEEN ST. VINCENT STREET AND HOWARD STREET FROM ST. LOUIS <br />BOULEVARD TO FIRST NORTH/SOUTH ALLEY <br />Mr. Gilot indicated that Attorney James Masters on behalf of Blaire Adams RET, LLC c/o <br />Thomas J. Gryp, Manager, 15852 Asheville Lane, Granger, Indiana 46530, has submitted a <br />request to vacate the above referencedalley to expand the property or construct and additional <br />home to enhance the neighborhood appearance. Mr. Gilot advised the Board is in receipt of <br />favorable recommendations concerning this Vacation Petition from the Area Plan Commission, <br />Police Department, Fire Department, and Solid Waste. Community Investment gives a favorable <br />recommendation provided there is no loss of access for other property owners. Engineering gives <br />a favorable recommendation subject to securing and stabilizing a narrow chamfer of property to <br />allow a turning radius. Area Plan stated the vacation would not hinder the growth or orderly <br />development of the unit or neighborhood in which it is located or to which it is contiguous. The <br />vacation would not make access to the lands of the aggrieved person by means of public way <br />difficult or inconvenient. The vacation would not hinder the public's access to a church, school <br />or other public building or place. The vacation would not hinder the use of a public right-of-way <br />by the neighborhood in which it is located or to which it is contiguous. Therefore, Mr. Relos <br />made a motion recommending approval of the request for vacation subject to obtaining an <br />easement for and the construction of a chamfer designed by the Engineering Department. Ms. <br />Maradik seconded the motion which carried. <br />DENY TRAFFIC CONTROL DEVICES <br />Upon a motion made by Ms. Doran, seconded by Ms. Maradik and carried, the following traffic <br />control devices were denied: <br />NEW INSTALLATION: Residential Parking Zone <br />LOCATION: 1500 Block of Hildreth Street <br />REMARKS: Study concluded criteria has not been met, recommend <br />denial. (Note: Petitioner has moved and other residents do <br />not feel it is warranted.) <br />NEW INSTALLATION: Handicapped Accessible Parking Space Sign <br />LOCATION: 1605 Kemble Avenue <br />REMARKS: Criteria has not been met; there is a driveway. <br />
