<br />APPROVF. REQUEST TO REJECT BIDS AND RE ADVERTISE CENTURY CENTER
<br />SERVICE COURT IMPROVEMENTS —PROJECT NO. 116-006 1OTEUMOTEL TAX
<br />Mr. Richard Estes, Engineering, advised the Board that on May 10, 2016, a sole bid was received
<br />and opened for the above referenced project. After reviewing the bid, Mr. Estes recommended
<br />that the Board reject the bid due to it being deemed non -responsive as it was only for the
<br />electrical work and not the project as a whole. Additionally, Mr. Estes requested the Board
<br />approve to re -advertise for bids. Therefore, Mr. Relos made a motion that the recommendation
<br />be accepted and the bid be rejected as outlined above and the project be re -advertised. Ms. Dorau
<br />seconded the motion, which carried.

<br />Mr. Richard Estes, Engineering, advised the Board that on May 10, 2016, bids were received and
<br />opened for the above referenced project. After reviewing the bids, Mr. Estes recommended that
<br />the Board reject the one bid due to it being over the amount budgeted for the project. The second
<br />bid was deemed non -responsive as they only bid on the electric work not the project as a whole.
<br />Additionally, Mr. Estes requested the Board approve to re -advertise for bids. Therefore, Ms.
<br />Maradik made a motion that the recommendation be accepted and the bid be rejected as outlined
<br />above and the project be re -advertised. Ms. Dorau seconded the motion, which carried.
<br />BOARD ATTORNEY EXCUSED FROM BOARD MEETING
<br />Attorney Michael. Schmidt excused himself from the meeting and was replaced by Attorney
<br />Benjamin Dougherty at 9:47 a.m.
<br />APPROVE REQUEST TO RESCIND BID AWARD AND RE AWARD LAWN CARE
<br />SERVICES FOR THE CITY OF SOUTH BEND, DIVISION C — PROJECT NO. 116-002

<br />In a memo to the Board, Mr. Corbitt Kerr, Engineering, advised that on April 26, 2016, the
<br />above bid was awarded to Kennedy Expressline Lawn Services, the lowest responsive and
<br />responsible. bidder. Following the award, the Department of Public Works made numerous
<br />efforts to work with the contractor to complete the contract documents, nonetheless the lowest
<br />bidder has been nun -responsive. Per Section VIII.B.2 of the contract specifications, the Board of
<br />Works is authorized to rescind the award if the bidder does not submit a fully executed contract
<br />and contract documents within fourteen (14) days from the award. 'therefore, Mr. Kerr requested
<br />the Board usurp their authority and rescind the award to Kennedy Expressline Lawn Services as
<br />non -responsive and award Division C to the next lowest bidder, Caretaker Landscaping & Lawn
<br />Services in the amount of $2,280. Upon a motion by Ms. Maradik, seconded by Ms. Doran and
<br />carried, the award of the bid to Kennedy Expressline Lawn Services was rescinded and the bid
<br />was awarded to Caretaker Landscaping & Lawn Services as requested. Mr. Gilot noted the delay
<br />in this bid has done some harm to the City in the forth of additional costs to the City, and delays
<br />in the schedule. He stated the Director of Public Works asked that the Board not consider future
<br />bids as responsible from this bidder. Attorney Dougherty questioned if there was a time limit set
<br />on this request. Mr. Gilot stated there is not, that legal should set that, adding there should be a
<br />clear message to change behavior so as not to waste everyone's time and fall behind schedule.
<br />Mr. Dougherty stated he would work with Attorney Schmidt on creating a resolution to set
<br />parameters for these situations.
<br />AWARD QUOTATION — TWO (2) NEW ZERO TURN RIDING MOWERS (SEWER
<br />DEPARTMENT CAPITAL
<br />Mr. Jeffrey Hudak, Central Services, advised the Board that on May 10, 2016, quotations were
<br />received and opened for the above referenced equipment. After reviewing those quotations, Mr.
<br />Hudak recommended that the Board award the contract to the lowest responsive and responsible
<br />bidder, Rigg's Outdoor Power, 825 Meijer Drive, Mishawaka, Indiana 46544, in the unit price
<br />amount of $12,900.00 for a total $25,800.00. Therefore, Mr. Relos made a motion that the
<br />recommendationbe accepted and the quotation be awarded as outlined above. Ms. Maradik
<br />seconded the motion, which carried.

<br />Ms. Hana Parkhill, Engineering, advised the Board that on May 10, 2016, quotations were
<br />received and opened for the above referenced project. After reviewing those quotations, Ms.
<br />Parkhill recommended that the Board award the contract to the lowest responsive and
<br />responsible bidder, Douglas Landscape, Inc., 23590 Ardmore Trail, South Bend, Indiana 46628,
