<br />Area No. 23 for the LaSalle Square Area and Expansion Area No. 24 for the Marycrest/Hurwich
<br />• Area in the Airport Area and Allocation Area No. 1; and (iv) adopts an amendment to the Airport
<br />Economic Development Area Plan previously adopted by the Commission to include the
<br />Sample-Ewing Area and the New Areas as part of the Airport Area and Allocation Area No. 1
<br />entitled "Amendment to the Airport Economic Development Area Development Plan" (the "Plan
<br />Amendment"), all within the meaning of the Redevelopment of Cities and Towns Act of 1953, as
<br />amended, which has been codified in Indiana Code 36-7-14 et. secd. (the "Act"), said Airport
<br />Area, as consolidated and expanded, being more particularly described in Exhibit A attached
<br />hereto and incorporated herein; and
<br />WHEREAS, certain Findings of Fact have been presented to the Commission
<br />which concern the location, physical condition of structures, land use, environmental influences
<br />and other economic conditions of the Airport Area, as consolidated and expanded, and the
<br />Commission now desires to adopt and confirm the Findings of Fact for the Airport Area, as
<br />consolidated and expanded; and
<br />WHEREAS, the St. Joseph County Area Plan Commission (the "Plan
<br />Commission"), which is the duly designated and acting planning body for the City, on June 19,
<br />2007, adopted a resolution, which is its written order approving the Declaratory Resolution and
<br />the Plan Amendment; and
<br />WHEREAS, the Plan Commission, by said written order, has certified that the
<br />Declaratory Resolution and the Plan Amendment conform to the general plan of development for
<br />• the City; and
<br />WHEREAS, the Common Council of the City (the "Common Council") on
<br />June 25, 2007, adopted a Resolution approving the written order of the Plan Commission, the
<br />Plan Amendment, and the Commission's determination that the Sample-Ewing Area and the New
<br />Areas are economic development areas for the purpose of consolidating the Sample-Ewing Area
<br />and the Sample-Ewing Allocation Area with and into the Airport Area and Allocation Area No. 1
<br />to form a Consolidated Area, which shall maintain the base assessment dates for the respective
<br />allocation areas, and for the purpose of expanding the Airport Area to include the New Areas;
<br />and
<br />WHEREAS, the Commission caused to be published a Notice of Public Hearing
<br />concerning the Area on July 6, 2007, in the South Bend Tribune and the Tri-County News,
<br />respectively, and made all required filings with governmental agencies and officers pursuant to
<br />and in accordance with Section 17(b) and (c) of the Act; and
<br />WHEREAS, at the hearing held by the Commission on July 20, 2007, at 10:00
<br />a.m., local time, on the 13`'' Floor of the County-City Building, 227 W. Jefferson Boulevard,
<br />South Bend, Indiana, the Commission heard all the persons interested in the proceedings and
<br />received written remonstrances and objections that had been filed and, considered those
<br />remonstrances and objections, if any, and such other evidence presented;
<br />NOW, THEREFORE, BE IT RESOLVED, by the South Bend Redevelopment
<br />• Commission as follows:
