REGULAR MEETING JULY 112009 228 <br />Mr. Gilot advised that Mr. Toy Villa, has submitted a request for a Certificate of Substantial <br />Completion on behalf of Majority Builders, Inc., 62900 U.S. 31 South, South Bend, Indiana <br />46614, for the above referenced project. Upon a motion made by Mr. lnl,--s, seconded by Mr. <br />Murphy and carried, the Certificate of Substantial Completion was approved. <br />APPROVAL Cl REQUEST TO ADVERTISE FOR THE RECEIPT OF BIDS <br />Mr. Gary Gilot advised that the following projects were submitted for permission to advertise for <br />the receipt of bids: <br />A. Michigan Street Streetscapes Phase 11 — Project No. 109-048 (Downtown TIF) <br />B. Granulated Activated Carbon — Water Works (MTBE Settlement Money) <br />C. Raw Sewage Pump No. I — Project No. 109 -039 (Waste Water Capital) <br />D. Abandoned Vehicles <br />Therefore, -upon a motion for their separate approval made by Mr. Inks, seconded by Mr. <br />Murphy and carried, the above requests were approved. <br />APPROVE TITLE SHEET— NEW LONDON LAKE & CLAY SUNNYIROO <br />STATION IMPROVEMENTS — PROJECT 109-068 (2007B SEWER BOND) <br />Mr. Gilot advised that the Title Sheet for the above referenced project was being presented at th <br />time for execution. Upon a motion made by Mr. Inks, seconded by Mr. Murphy and carried, t <br />above referred to Title Sheet was approved and signed. <br />A RESOLUTION OF THE CITY OF SOUTH BEND BOARD OF PUBLIC WORKS <br />RELATED TO ACQUISITION OF PROPERTY IN THE CITY OF SOUTH BEND, <br />INDIANA <br />I I !I Jill <br />WHEREAS, pursuant to Indiana Code §36-9-6-3 and Indiana Code §32-24-2-4, the City of <br />South Bend, Indiana, Board of Public Works (ABoard@) is the entity vested with the authority and <br />power to acquire, receive, manage and care for the property of the City and to construct the Project; <br />and <br />WHEREAS, in order to properly complete the Project it is necessary to acquire and the City <br />wants to acquire a permanent and temporary interest in all or part of certain parcels located at 1601 <br />Lincolnway East as more particularly described and depicted on Exhibit "A" and Exhibit "B" as a <br />"Temporary Easement" and "Utility Easement" (collectively "Property"), said exhibits being <br />attached hereto and incorporated herein; and <br />WHEREAS, the Property is owned by the persons or entities set forth in Exhibit "C"; and <br />WHEREAS, the Property will be used by the City during construction on the Project in order <br />to construct the Project and upon completion of the Project, that portion of the Property depicted on <br />
