REGULAR MEETING <br />JULY 14, 2015. 231 <br />that the Board award the contract to the lowest responsive and responsible bidder Walsh & <br />Kelly, Inc., 24358 State Road 23, South Bend, Indiana 46614, in the amount of $100,330.00 in <br />unit prices per bid for Division A and $134,775.00 in unit prices per bid for Division C. <br />Therefore, Mr. Relos made a motion that the recommendation be accepted and the bid be <br />awarded as outlined above. Ms. Maradik seconded the motion, which carried. <br />AWARD BID --- _2.015 CURB & SIDEWALK PROGRAM - PROJECT NO. 115 -069B (MVH) <br />Ms. Blair Bennett, Engineering, advised the Board that on July 9, 2015, bids were received and <br />opened for the above referenced project. After reviewing those bids, Ms. Bennett recommended <br />that the Board award the contract to the lowest responsive and responsible bidder Selge <br />Construction Company, Inc., 2833 South IIth Street, Niles, Michigan 49120, in the amount of <br />$245,594.25 in unit prices per bid for Division B. Therefore, Mr. Relos made a motion that the <br />recommendation be accepted and the bid be awarded as outlined above. Ms. Maradik seconded <br />the motion, which carried. <br />APPROVE CHANGE ORDER NO. 3 — PRIMARY CLARIFIER REHABILITATION AND <br />EQUIPMENT UPRADES — PROJECT NO. 111 -071 (WASTEWATER CAPITAL AND /OR <br />2012 SEWER BONDI <br />Mr. Gilot advised that Mr. Jacob Klosinski, Environmental Services, has submitted Change <br />Order No. 3 on behalf of L. D. Docsa & Associates, Inc., 1605 King Highway, Kalamazoo, <br />Michigan, 49001, indicating a time extension of ninety -eight (98) days. Mr. Gilot noted the <br />contractor was not able to work due to weather delays beyond their control. He stated future <br />contract language should be fixed to address the weather conditions. Mr. Murray Miller, Local <br />Union 645, stated every other contractor was working around the City in February, why was this <br />one not able to work and why weren't they being given liquidated damages. Mr. Gilot noted it <br />was the nature of the work being done that couldn't be completed in the extreme weather <br />conditions, and there was no language in the contract to cover weather conditions, so the City <br />had no contract language to fall back on. Mr. Jacob Klosinski, Environmental Services, added <br />the time extension doesn't eliminate the contractor from damages, they will be assessed <br />liquidated damages. Mr. Gilot agreed, noting even when they are given days, they will still be <br />assessed big liquidated damages. He added this is not the end of this issue. Upon a motion made <br />by Mr. Relos, seconded by Ms. Maradik and carried, the Change Order was approved. <br />APPROVE CHANGE ORDER NO. 4 — PRIMARY CLARIFIER REHABILITATION AND <br />EQUIPMENT UPRADES — PROJECT NO. 111 -071 WASTEWATER CAPITAL AND /OR <br />2012 SEWER BOND) <br />Mr. Gilot advised that Mr. Jacob Klosinski, Environmental Services, has submitted Change <br />Order No. 4 on behalf of L. D. Docsa & Associates, Inc., 1605 King Highway, Kalamazoo, <br />Michigan, 49001, indicating the Contract amount be increased by $4,426.11 for a new Contract <br />sum, including this Change Order, in the amount of $5,090,853.78 and a time extension of <br />seventeen (17) days. Upon a motion made by Mr. Relos, seconded by Mr. Pawlowski and <br />carried, the Change Order was approved. <br />APPROVE CHANGE ORDER NO. 5 — PRIMARY CLARIFIER REHABILITATION AND <br />EQUIPMENT UPRADES — PROJECT NO. (WASTEWATER CAPITAL AND /OR <br />2012 SEWER BOND) <br />Mr. Gilot advised that Mr. Jacob Klosinski, Environmental Services, has submitted Change <br />Order No. 5 on behalf of L. D. Docsa & Associates, Inc., 1605 King Highway, Kalamazoo, <br />Michigan, 49001, indicating a time extension of fifty -five (55) days due to inclement weather. <br />Upon a motion made by Mr. Pawlowski, seconded by Ms. Maradik and carried, the Change <br />Order was approved. <br />TABLE APPROVAL OF PROJECT COMPLETION AFFIDAVITS — VACANT AND <br />ABANDONED HOMES DEMOLITIONS DIVISIONS D E AND F - PROJECT NO. 114 -073 <br />LOSS RECOVERY FUND <br />Mr. Gilot advised that Ms. Thia Vawter, Engineering, has submitted the Project Completion <br />Affidavits on behalf of Indiana Earth, 10343 McKinley Highway, Osceola, IN 46561, for the <br />above referenced project, indicating a final cost of $345,624.00 for Division D; $449,313.00 for <br />Division E; and $155,168.00 for Division F. Ms. Maradik made a motion that this item be tabled, <br />Mr. Relos seconded the motion, which carried. <br />
