-37- <br />Section CXXXIX. It shall be unlawful for any person <br />to detach and remove any of said fixtures from any building <br />in which the same is installed or to install any of said <br />fixtures, unless such fixtures have securely attached thereto <br />a label or sticker as described in section one hundred thirty - <br />eight. <br />Section CXL. Any person desiring to secure labels herein- <br />above described shall make written application to the Plumbing <br />Inspector of the City of South Bend upon blanks to be furnished <br />by the City of South Bend, which application shall show, (a) <br />the rame and address of the applicant; (b) the number and kind <br />of new and second -hand fixtures to be labeled; (c) That the <br />applicant has a good title to said fixtures or a right to <br />remove or install the same; (d) Such other information as <br />the Plumbing Inspector may require. When the Plumbing <br />Inspector is satisfied that the applicant is entitled thereto <br />such label shall be attached to such fixtures of the applicant <br />by the Plumbing Inspector, or one of his assistants. It shall <br />be the duty of the Plumbing Inspector to keep a record of all <br />labels affixed by him or his assistants to any such fixture. <br />Section CXLI. It shall be unlawful for any person to <br />purchase or receive thru exchange or otherwise, within the <br />City of South Bend or the police jurisdiction thereof, any <br />of the above named fixtures, whether new or second -hand <br />except direct from the manufacturers thereof, unless such <br />fixtures bear a label as hereinabove described. The possession <br />of any detached second -hand fixture: above described not <br />bearing a label as hereinbefore described shall be prima - <br />facie evidence that such possession is unlawful and a <br />violation of this ordinance and the burden of proof shall <br />be upon the possessor to show that his or its possession <br />is lawful. <br />
