2 <br />3). A Variance from the requirement of providing a minimum of a 6 ft. <br />wide landscape planting area along the Elwood Avenue fagade of the <br />existing building to no landscaping and to a minimum of 15 shrubs along <br />the Olive Street fagade as shown. <br />4). A Variance to encroach into the 20 ft. Side Residential Bufferyard <br />area along the East property line to a minimum of 1 ft. for existing <br />driveway pavement area, parking, a proposed Dumpster, Dumpster <br />enclosure, and a screening fence as shown. <br />5). A Variance from the requirement of providing Type "B" Residential <br />Bufferyard screening along the East and South property lines to <br />providing a minimum 6 ft. high landscape screening fence along said East <br />property line, with a 4 ft. high screening fence in the 30 ft. Front - <br />yard setback area and to using existing vegetation along the South <br />property line as shown. <br />SPECIAL EXCEPTION REQUEST: <br />1) . Approval of a Special Exception Use as allowed under Section 21- <br />03.04 (a)(2)(A) Automotive Uses, of the City of South Bend Zoning <br />Ordinance to allow for a Gasoline Service Station facility (without <br />repairs) on property zoned LB Local Business District. <br />The Petitioners are the owners of the real estate parcel shown on <br />the attached site plan and as shown in the records of the St. Joseph <br />County, Indiana Auditor's office. The Petition property presently has a <br />Zoning classification of "LB" Local Business District. <br />The property is being used as a Convenience Store. The Petitioners <br />desire to renovate the interior of the existing building to update and <br />modernize the facility. The exterior is proposed as well to get a <br />renovation, which has not occurred for several years. As part of the <br />renovation of the existing facility the Petitioners desire to install <br />gas pump islands and a Canopy, providing the surrounding neighborhood <br />with the ability to fuel their vehicles at a location close to their <br />homes. <br />Through discussions with the Building Department and Area Plan <br />Commission staffs, it was determined that in order to install the gas <br />pumps with a Canopy, approval of a Special exception and a few Variances <br />would be required due to the fact the City Ordinances have changed. <br />More specifically, the following Variances and Special Exception are <br />being requested to be approved. <br />With regards to the required Variances, the first request is to <br />allow an encroachment into the 30 ft. Front Residential Bufferyard area <br />along Elwood Avenue (North property line) to a minimum of 4 ft. for <br />existing driveway pavement area and a proposed Canopy facility with <br />pumps as shown and to a minimum of 4.50 ft. along Olive Street (West <br />property line) for existing driveway pavement area, proposed sidewalk <br />and Canopy facility with pumps and parking.
