REGULAR MEETING OCTOBERT 28, 2013 <br /> <br />Councilmember Davis: And the Clerk’s Office. <br />Chairperson White: Dr. Varner would like to receive a motion regarding Bill 46-13. <br />Council Attorney Kathleen Cekanski-Farrand: Again the proper motion would be to continue <br />Bill No. 46-13 in the Council Portion Only and to set if for Third Reading at the Special <br />Common Council Meeting on October 30, 2013. <br />Councilmember Oliver Davis made a motion to continue Bill No. 46-13 in the Council Portion <br />Only and to set if for Third Reading at the Special Common Council Meeting on October 30, <br />2013. Councilmember Scott seconded the motion which carried by a voice vote of nine (9) ayes. <br />Council Attorney Kathleen Cekanski-Farrand: That would include 22 Enterprise Funds. <br /> <br />BILL NO. 58-13PUBLIC HEARING ON A BILL TO VACATE <br /> <br /> THE FOLLOWING DESCRIBED PROPERTY: <br /> THE FIRST NORTH/SOUTH ALLEY EAST OF <br /> GEORGIANA STREET, WEST OF BURNS <br /> STREET RUNNING NORTH FROM THE FIRST <br /> EAST-WEST ALLEY SOUTH OF NAPOLEON <br /> STREET FOR A DISTANCE OF <br /> APPROXIMATELY 54.5 FEET TO ITS <br /> TERMINATION POINT. 2. THE FIRST <br /> NORTH/SOUTH ALLEY EAST OF BURNS <br /> STREET, WEST OF DUEY AVENUE RUNNING <br /> NORTH FROM THE FIRST EAST/WEST ALLEY <br /> SOUTH OF NAPOLEON STREET FOR A <br /> DISTANCE OF APPROXIMATELY 56 FEET TO <br /> IT’S TERMINATION POINT <br /> <br />Councilmember Oliver Davis, Chairperson, Public Works and Property Vacation Committee, <br />reported that this Committee met this afternoon and it was the consensus of the Committee to <br />send this bill to the full Council with a favorable recommendation. <br /> <br />Mr. Mike Danch, President, Danch, Harner & Associates, Inc., 1643 Commerce Drive, South <br />Bend, Indiana, made the presentation for this bill. <br /> <br />Mr. Danch advised that they are requesting this vacation to allow for the development of the <br />property on the south side of Napoleon Street into single-family attached townhomes. <br /> <br />This being the time heretofore set for the Public Hearing on the above bill, proponents and <br />opponents were given an opportunity to be heard. <br /> <br />There being no one present wishing to speak to the Council either in favor of or in opposition to <br />this bill, Councilmember Oliver Davis made a motion for favorable recommendation to full <br />Council concerning this bill. Councilmember Scott seconded the motion which carried by a <br />voice vote of nine (9) ayes. <br /> <br /> <br />BILL NO. 53-13 PUBLIC HEARING ON A BILL FIXING <br /> MAXIMUM SALARIES AND WAGES OF <br /> APPOINTED OFFICERS AND NON- <br /> BARGAINING EMPLOYEES OF THE CITY OF <br /> SOUTH BEND, INDIANA, FOR THE <br /> CALENDAR YEAR 2014 <br /> <br />Councilmember Dieter made a motion to continue Bill No. 53-13 to October 30, 2013 Special <br />Meeting of the Council. <br />Chairperson White: Bill No. 53-13 we will need to have a Public Hearing on that. <br />13 <br /> <br /> <br />
