SPECIAL MEETING <br />PETITION <br />NOVEMBER 13TH. 1951 <br />To The Honorable South Bend City Council <br />City Hall <br />South Bend, Indiana Re: Petition of Dr. William M. Smith for Rezoning of Lot <br />1085, LaSalle Park Addition <br />J. Chester Allen, being first duly sworn says: <br />That he is the attorney and duly authorized representative of Doctor William M. Smith, a resident and property <br />owner residing at 2801 Lincolnway West, South Bend, Indiana. <br />That the said :Doctor William M. Smith is the owner of Lot Number 1085 in the LaSalle Park Addition to the City <br />of South Bend, St. Joseph County, Indiana, which real estate is an unimproved parcel of land on the northwest <br />corner of Falcon and Washington Streets and adjacent to the city dump immediately north of said real estate. <br />That said real estate is at the present time zoned as Residential property. <br />That the said Doctor William M. Smith is desirous of rezoning said real estate from Residential to Commercial <br />in order that he may erect a drug store thereon. <br />WHEREFORE, for and on behalf of the said Doctor William M. Smith, the affiant respectfully petitions the South <br />Bend City Council to pass a resolution according to law rezoning the above described parcel of real estate from <br />Residential to Commercial. <br />Respectfully submitted, <br />J. CHESTER ALLEN, Attorney for Dr. William M. Smith <br />Councilman Korpal made a motion that the petition be referred to the City Plan Commission. Councilman Bestle <br />seconded the motion. Motion carried. <br />REPORT <br />OF THE <br />COMMITTEE <br />OF THE WHOLE <br />To the <br />Common <br />Council of <br />the City of South Bend: <br />Your Committee of the Whole to whom was referred "An Ordinance reducing certain items in the 1951 South Bend, <br />Indiana, Municipal Civil City Budget and appropriating from the General Fund of said city'the sum of Twelve <br />Thousand Six Hundred ($12,600.00) Dollars, to certain other budgetary items of the 1951 budget of said city, <br />and declaring an extraordinary emergency ". <br />Respectfully report that they have examined the matter and that in their opinion this ordinance go to the <br />Council as favorable. <br />STANLEY C. KOTPAL, Chairman <br />Councilman Kemper made a motion that the report be accepted. Councilman Glass seconded the motion. Motion <br />carried. <br />REPORT- OF CITY PLAN "COMMISSION. <br />To the Common Council <br />City of South Bend, Indiana <br />Gentlemen: <br />Petition of Harry R. Green for change of zoning of an unplatted tract of land on the south side of `Lincolnway <br />West, East of Sheridan_;Avenue, as described by meets and bounds in the petition asking for a change of zoning <br />from B residence and A height and area districts to C - commercial was given public hearing at the meeting of the <br />City Plan Commission on November 1, 1951, and,it is recommended that change be made to C commercial and D height <br />and area district. <br />Councilman Korpal made a motion that the report be accepted. <br />carried. <br />REPORT OF CITY PLAN COMMISSION <br />To the Common Council <br />City of South Bend, Indiana <br />Gentlemen: <br />Yours truly, <br />D. Moomaw, Secretary <br />Councilman Bestle seconded the motion. Motion <br />Petition of First Bank and Trust Company by their attorney, William E. Voor, for zoning land recently annexed <br />to the City of South Bend by annexation Ordinance No. 3828 was given public hearing at the meeting of the City <br />Plan Commission on November 1, 1951. This property is at the northeast corner of Ireland Road and Miami Street <br />and extends north to the property. of St. Mary's Academy. <br />'The platting of this landhas not yet been done and hence it cannot be described as numbered lots in a recorded <br />addition.
