IT�ION TO THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA: WHEREAS, the undersigned, the owner of a tract of land fronting 192 feet East and West on both the North and South side of McKinley Road (sometimes referred to as U. S. #20) and lying immediately East of Walnut Grove Addition to the Dity of South Bend, and which tract of land is legally described as follows: Beginning at the Northwest corner of the Northeast Quarter of Section 8, Township 37 North Range 3 East; thence South on the North and South Sectional Center Line 455.5 feet; thence East 192 feet; thence North 455.5 feet to the North line of said Section; thence West along the North line of said Section to place of beginning. and. , WHEREAS, that part of the afore described tract of land lying North of McKinley Road is zoned commercial, and that part lying South of McKinley Road is zoned residential. NOW THEREFORE, the undersigned, owner of said tract of land petitions your Honorable Body to amend Ordinance #3702 - -as it applies to that part of the real estate lying South of McKinley Road and described as follows, to -wit: Beginning on the North and South center line of Section 8, Township 37 North, Range 3 East at a point 184.5 feet South of the Northwest corner of the Northeast Quarter of said Section, said point being on the South line of McKinley Road; thence South 160 feet; thence East 192 feet; thence North to the South line of McKinley Road; thence Northwesterly along the South line of McKinley Road to the place of beginning* changing said desribed real. .-.estate from "A" residential to "C -1" commercial, and from "A" height and area to "D" height and area. Councilman lorpal seconded the motion. Motion carried. REPORT OF THE COMMITTEE OF THE WHOLE To the Common Council of the :City of South Bend: November 28th, 1949 Your Committee of the Whole to whom was referred "AN ORDINANCE AMENDING SECTION 38 OF CHAP TER 29 OF ORDINANCE N0. 37099 KNOWN AS THE 1949 MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIA NA." Respectfully report that they have examined the matter and that in their opinion in Section B the word "place" in the 8th line thereof shall be stricken out and in place thereof the word "operation" shall be inserted, and with that amendment the ordinance should go to the Council as favorable. November 28th, 1949 Your Committee of the Whole to whom was referred "AN ORDINANCE REDUCING CERTAIN ITEMS IN THE 1949 SOUTH BEND, INDIANA, MUNICIPAL CIVIL CITY BUDGET IN SEVERAL OFFICES AND DEPARTMENTS THEREOF, AND APPROPRIATING SPECIFIC SUMS FROM THE GENERAL FUND AND FROM THE GENERAL STREET AND TRAFFIC FUND OF SAID CITY TO CERTAIN OTHER BUDGETARY ITEMS OF THE 1949 MUNICIPAL CIVIL CITY BUDGET OF SOUTH BEND, INDIANA, AND DECLARING AN EXTRAORDINARY EMERGENCY ". Respectfully report that they have examined the matter and that in their opinion this ordinance should go to the Council as favorable. STANLEY C. Motion ORDINANCE NO. 3727 AN ORDINANCE AMENDING SECTION 38 OF CHAPTER 29 OF ORDINANCE NO. 3709 KNOWN AS THE 1949 MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA. The ordinance was given third reading and passed by a roll call vote of 8 ayes - 0 nays.
