REGULAR MEETING FEBRUARY 14TH, 1949 <br />ORDINANCE <br />ORDINAMT E AMENDING ORDINANCE # 2331 (AS AMENDED) COMMONLY <br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND, <br />INDIANA. (ALL OF PINHOOK MANOR, EXCEPTING LOTS NUMBERED <br />1 TO 22 INCLUSIVE) <br />The ordinance was given first reading by title and second reading in full. Councilman Niezgodski made a motion <br />that the ordinance be referred to the Committee of the Whole on February 28th, 1949, at 8:00 P.M. 'Councilman <br />Glass seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE AMENDING ORDINANCE # 2331 COMMONLY KNOWN AS THE <br />ZOMING ORDINANCE OF THE CITY OF SOUTH BEND, INDIANA. <br />(LOTS 632 & 633 IN SUMMIT PLACE THIRD ADDITION) <br />The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion <br />that the ordinance be held up in Council until further information ban be obtained from the owner regarding <br />the reason for change in zoning. Councilman Muszynski seconded the motion. Motion carried. <br />ORDINANCE <br />AN ORDINANCE APPROPRIATING FROM THE GENERAL STREET AND <br />TRAFFIC FUND OF THE CITY OF SOUTH BEND, INDIANA, THE SUM <br />OF EIGHT HUNDRED FIFTY DOLLARS ($850.00) TO THE FOLLOWING <br />ACCOUNT OF THE 1949 BUDGET: STREET DEPARTMENT, S -51, <br />' INSURANCE, AND DECL.i.RING AN EXTRAORDINARY EMERGENCY- <br />The ordinance was given first reading by title and second reading in full. Councilman Korpal made a motion <br />that the ordinance be referred to the Committee of the Whole for Public Hearing on February 28th, 1949, at <br />8:00 P -M. Councilman Kemper seconded the motion. Motion carried* <br />ORDINANCE <br />AN ORDINANCE TO AMEND PARAGRAPH2 OF SECTION 2 OF ORDINANTCE <br />NO. 1749 ENTITLED "AN ORDINANCE ADOPTING CERTAIN RULES AND <br />REGULATIONS FOR THE GOVERNMENT OF THE COMMON COUNCIL OF THE <br />CITY OF SOUTH BEND, INDIANA, AND ITS MEMBERS ", ADOPTED <br />N07FMBER 9, 1914, AS A MENDED BY ORDINANCE NO. 3630, ADOPTED <br />BY THE COMMON COUNCIL ON MARCH 8, 1948. <br />The ordinance was given third reading- Councilman Tellson Made a motion that the ordinance be tabled <br />Indefinitely, Councilman Glass seconded the motion. Motion carried by a roll call vote of 6 ayes - 2 not <br />voting (Niezgodski and Kemper)- <br />RESOLUTION <br />TYMREAS, there -4s now before the State Legislature Bill No. 138 proposing an increase in the size and weight <br />of trucks permitted for use on the highways of our state and cities., And <br />WHEREAS, it is necessary for tracks to traverse South Bend streets to connect with highways leading into the <br />city, and <br />WHEREAS, to increase the weight and size of trucks traversing our city streets would further break down our <br />street pavements, and <br />WHEREAS, the burden of repair and paving our city streets is now a heavy financial burden for our tax - payers, <br />and <br />WHEREAS, the state government has not given South Bend sufficient financial aid to properly maintain such <br />city streets. <br />NOW THEREFORE BE IT RESOLVED by the South Bend City Council that we are opposed to the passage of any weight <br />increase for trucks in Bill No. 138, and that if such bill is passed which would provide for an increase of <br />weight for trucks, we would find it necessary to seriously consider the enactment of an ordinance prohibiting <br />the use of such increased weight of trucks on our city streets. <br />(Signed) MEMBERS OF THE COMMON COUNCIL <br />Councilman Niezgodski made a motion to adopt this amended resolution. Councilman Muszynski seconded the <br />motion. Motion carried* <br />RESOLUTION <br />A Resolution by the Common Council for the City of South Bend, Indiana, urging the passage of House Bill <br />Number 17- <br />WHEREAS, there has been introduced and there is now pending in the House of Representatives in the General <br />Assembly of the State of Indiana, House Bill Number 17, which, if passed, would make a more equitable <br />distribution of costs for separation of grades on public thoroughfares and railroads in the State of Indiana, <br />and <br />WHEREAS, there are other cities in the State of Indiana that are desirous of securing separation of grades <br />and in the interests of safety of the people using highways in the State, a more equitable distribution costs <br />of grade separations should be provided, and <br />WHEREAS, the Common Council of the City of South Bend is of the opinion that House Bill Number 17 should be <br />enacted into law, and <br />WHEREAS, the said Common Zouncil of the City of South Bend stands ready and willing to expend all its <br />available effort in seeking the passage of said bill. <br />(CONTINUED ON RTEXT PAGE) <br />
