PETITION: South Bend, Indiana. <br />July 15, 1946 <br />TO ZiE HONORABLE C014UiON COUNCIL OF THE <br />CITY OF SOUTH BZ0, INDIANA: <br />Gentlemen: <br />South Bend Band and Gravel Company respectfully represents and alleges: <br />1. It has long been and is now the owner in fee simple or in possession and control of a tract of real <br />estate in the City of.South Bend, Indiana, bounded by a line running as follows: <br />Beginning at the Northwest corner of Section 34, Township 38, North, Range <br />2-East; thence East a distance of 1,320 feet; thence South a disten ce of <br />2,415.6 feet; thence 71est a distance of 750.1 feet; thence South a distance of <br />824.4 feet to the Northeast corner of Lot 208 in Lincoln Terrace Addition] thence <br />;'hest to the Northwest corner of Lot 225 in said Addition; thence South to the <br />Southwest corner of Lot 228 in mid Addition; thence Northwesterly along the <br />Southwesterly line of Lots 228 and 234 in said addition to the intersection of <br />such line and the center line of Bendix Drive; thence North to the place of beginning. <br />2. The-petitioner has long owned and now owns in fee simple all of said described land, excepting Lots <br />2340 235 and 236 in said Lincoln Terrace Addition." Although legal title to said three lots is vested <br />in the Chicago, South Shore and South Bend Railroad, petitioner has long enjoyed and now enjoys the use <br />and control thereof as incident to the conduct of its industrial operations on the land described in <br />paragraph 1. <br />3. The land described in paragraph 1 is now zoned as "A" Residence District and "A" Height and Area <br />District. Petitioner desires that said area be rezoned as "E" Heavy Industrial District and "a" <br />Height and Area District. <br />V�HEREFORE, petitioner lu!�spectfully prays and requests that.zoning ordinance No. 2331 adopted June 250 192319 <br />as heretofore amended, be further amended in such manner as to zone the land described in paragraph 1 of <br />this petition as "E" Heavy Industrial District and "G" Height and Area District. <br />SOUTH REED SAh`D AND GRAVEL COMPANY, Petitioner <br />BY D. Motion carried. <br />REPORT OF THE COMMITTEE OF THE 11HOLE <br />TO THE COYMON COUNCIL OF THE CITY OF SOUTH BEND: <br />July 22nd, 1946, <br />Your Committee of the Mhole to was referred an Ordinance creating a position of Assistant <br />Plumbing Inspector, Appropriate funds for'the salary of an Assistant Plumbing Inspector during <br />the balance of the budgetary year of 1946; declaring an emergency. <br />Respectfully report that they have examined the matter and that in their opinion this Ordinance <br />should be reported to the Council favdrable. <br />. <br />Councilman Neezgodski made a motion that the report be accepted. Councilman Heideman seconded the motion. <br />Motion carried. <br />REPORT OF THE CITY PLAN COMMISSION , <br />To The Common Council of the City of South Bend. <br />Gentlemen: <br />July 12, 1946 <br />Petition of Stephen W. and Carrie M. Vavul, for change of zoning classification of Lot #189 of the <br />Original Plat of South Bend was considered by the City Plan Commission at a special meeting July 11th. <br />This lot is known as 519 and 521 No. Main Street. The City Plan Commission recommends the change as <br />petitioned for and it further recommends that the change be extended to,include Lots #187 and 188. Lot <br />187 being now occupied by the South Bend Medical Laboratory at the corner of Main and Navarre Sts. Lot <br />188 lies next South of the Medical Laboratory property. <br />Yours truly, <br />D. MOOMAW, Secy. <br />Councilman Bishop made a motion that the report be accepted. <br />Motion carried. <br />REPOIU OF THE CITY PLAN COMMISSION <br />To the Common Council of the City of South Bend. <br />Gentlemen: <br />Councilman Brannan seconded the motion. <br />July 12, 1946 <br />Petition of-C. D. Smelser for change of zoning classification of 26 ft. of the East side of Lot #17, <br />together with Lots J418 and X19, in Studebaker's Leeper Avenue Addition from "A" residence district <br />to "B" residence district,was considered by the City Plan Commission at a special meeting July 11th. <br />These lots lie on the South side of E. North Shore Drive immediately lest of the New York Central Railroad <br />tracks at Niles Avenue. <br />The City Plan Commission recommends this change as petitioned for. <br />Attached hereto is a written remonstrance ow owners of proper on E. North Shore Drive Lnd by reason of this <br />remonstrance a three- fourths vote of the Council will be necessary to make this chage. <br />D.
