<br />WHEREAS, the only mass transportation facility serving the City of SOUTH BEND, INDIANA is owned and operated
<br />by NORTHERN INDIANA TRANSIT, INC., an Indiana corporation, under exclusive franchise with the City of
<br />SOUTH BEND, INDIANA..
<br />WHEREAS, said Act further provides that in any such city the Common Council in order to maintain and provide
<br />adequate mass transportation facilities within-the city, may make a determination as to whether the public
<br />is to acquire the system or render assistance to such system.
<br />WHEREAS, the undersigned,acting by.and through the authority of The Board of Directors of NORTHERN INDIANA
<br />TRANSIT, INC., are of the opinion that the present mass transportation system is, within the foreseeable
<br />future, in imminent danger of being unable to continue to render adequate service within the City of
<br />SOUTH BEND, INDIANA
<br />NOW, THEREFORE, pursuant to a resolution of the Board of Directors of NORTHERN INDIANA TRANSIT, INC.,
<br />a copy of which is attached hereto and made a part hereof, the undersigned applies to and requests the
<br />COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA to make or cause to be made a study or studies of the
<br />existing system for the purpose of determining whether the financial position of the system is such that
<br />the system is unable to continue to render adequate service within the City or is in imminent danger of
<br />being unable to continue to render such service; and to determine from such study whether the COMMON COUNCIL
<br />should furnish assistance to the system for the purpose of providing the system with a financial position
<br />I� as will enable it to continue to render adequate service within the City or determine whether it is in

<br />the public interest that the public acquire the system.

<br />Councilman Smith made a motion that the Request be referred to the Transportation Committee. Councilman
<br />Geib seconded the motion. Motion carried.
<br />Councilman Smith inquired whether there would be a meeting on February 13, since it is a legal holiday
<br />and City Hall offices would be closed on that day. After a brief discussion, Councilman Allen made a
<br />motion that,regardless of the holiday, the next meeting be held on February 13, 1967. Councilman Szymkowiak
<br />seconded the motion. Motion carried.

<br />NO. 4608 -63 (Location: 3000 E. Jefferson Boulevard)
<br />The Ordinance was given first reading by title and-second reading in full. Councilman Allen made a
<br />motion that the Ordinance be set for public hearing on February 13, 1967. Councilman Szymkowiak
<br />seconded the motion. Motion carried.
