<br />Gentlemen:
<br />May 11, 1959
<br />The attached petition of Richard A. Muessel, Jr., to rezone the property generally described as being located on the
<br />northeast corner of Jefferson Boulevard and Eddy Street with a frontage of approximately 308 feet on Jefferson
<br />boulevard and approximately 722 feet on Eddy Street containing 4.5 acres, more or less, from "A" Residential Use
<br />District to "B" Residential Use District and "C':' Height and Area District was legally advertised on March 30, 1959,
<br />and given public hearing on April 9, 1959 and April 23, 1959. The following action was taken'

<br />After due consideration the following findings were adopted on motion duly made, seconded
<br />and unanimously carried:
<br />1. The City Planning Commission recognizes that a serious problem exists in maintaining
<br />the existing character of surrounding property and in the opinion of the Commission the
<br />proposed zoning will tend to maintain Jefferson Boulevard and the general area in its
<br />present character and further that it is the Commission's opinion that it would not be
<br />generally economically feasible were the subject property to be used for one single family
<br />dwelling.
<br />2. That the subject area is bordered on three sides by "B" multi - family Residential zoning
<br />and that on Eddy Street between Ewing Avenue on the south and Napoleon Street on the North
<br />there is no "A" single family zoning except the subject property, a distance of approximately
<br />four miles.
<br />It was therefore duly moved, seconded and carried (five ayes, one no) that the petition
<br />be recommended favorably to the Common Council.

<br />The attached petition of Charles and Katherine Cataldo, and others, to rezone land located on Lincolnway East
<br />between Twyckenham Drive and Caroline Street as follows: Lots Numbered 1 (1504 Lincolnway East), 2 (1508 Lincolnway
<br />East, 3 (1512 Lincolnway East), 4 and 5 (1514 Lincolnway East), 6 (1520 Lincolnway East), and 7 (1528 Lincolnway East
<br />as shown on the recorded plat of Clapp's Subdivision, and Lot Numbered 1 as shown on the recorded plat of Major's
<br />Addition to the City of South Bend, said parcel of land lying directly north of Lots 1 -7, inclusive, Clapp's Sub-
<br />division, from "b" Residential Use and "A" Height and Area District to "C" Commercial Use and "C" Height and Area
<br />District was legally advertised on April 27, 1959 and given public hearing on May 7, 1959. The following actiat was
<br />taken':
<br />After due consideration the Commission found that:
<br />1. The commercial zoning of subject property would constitute strip zoning.
<br />2. That both sides of Lincolnway East from Caroline Street east to the city limits was
<br />now zoned to allow commercial use, yet the predominant use is residential, thus
<br />clearly indicating the lack of demand or need for additional commercial zoning.
<br />3. That in the opinion of the Commission a part of the subject area, constituting
<br />almost half the front footage of the petition area and being specifically Lot No. 1,
<br />Major's Addition, is now in violation of Ordinance #3702, the Zoning Ordinance.
<br />It was therefore duly moved, seconded and unanimously carried that the petition be recommended
<br />unfavorably to the Common Council.

<br />bounded on the west and north by the present city limits was legally advertised on April 27, 1959 and given public
<br />hearing on May 7, 1959. The following action was taken:
