� 2 <br />COMMITTEE OF THE WHOLE MEETING DECEMBER 14, 1970 <br />RESOLUTION NO. 258 -70 Cont'd. <br />WHEREAS, A.C.T.I.O,N., Inc., a non- profit corporation and the agency designated to <br />administer the local anti-poverty program, desire to lease said premises for use in conducting <br />a Work Release Program under the administration of the Indiana State Department of Correction, <br />for May 4, 1970 through May 3, 1971, and <br />WHEREAS, the City of South Bend by virtue of said lease can obtain in -kind credits <br />toward its contribution to such program as required by the Federal Anti- Poverty Program, <br />NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br />INDIANA: <br />SECTION I. Pursuant to the authority set forth in <br />the year 1905, Chapter 129, that certain lease, entered into <br />Inc., and the City of South Bend by and through the Board of <br />Mayor, on the 13th day of July, 1970, which lease is attache, <br />incorporated herein by reference to the same extent as if it <br />approved and confirmed. <br />the Acts of the General Assembly for <br />by and between the A.C.T.I.O.N., <br />Public Works and Safety, and its <br />3 hereto, marked Exhibit "A ", and <br />were fully recited herein, is hereby <br />/s/ Fredrick D. Craven <br />Member of the CommonCouncil <br />A public hearing was held at this time on the resolution. Mr. Paul Cornell, Executive Director <br />of A.C.T.I.O.N., Inc., said he would like to speak as a private citizen in favor of the resolu- <br />tion. He said the Work Release program is the real effort on the part of the community to show <br />its concern to those who have been unfortunate enough to have created an act of aggression <br />against society. Mr. Robert Heyney, Indiana State Corrections Commissioner, said many people are <br />very uninformed about the Work Release Program and imagine the worst. He said the inmates <br />admitted to the program would be only those who are carefully screened by his staff, only those <br />who could adjust to this type of setting, and only men who had resided in South Bend before their <br />conviction. He also stated that the men participating in the work Release program would be <br />returning to the community within six to eight months anyway and this program helps get them <br />started and helps them find employment, therefore, they would not be a tax burden on the community <br />He stated that several other centers in the State of Indiana are very successful. Others speak- <br />ing in favor of the program were; Miss Mercedes Dwyer, 909 W. Colfax, South Bend; Mr. Roger <br />Parent, 917 Whitehall Dr., South Bend; and Mr. David James, 621 Rex St., South Bend. Mr. Leipold <br />Day and Mr. Rody accompanied Mr. Heyney from Indianapolis to speak for the resolution. Mr. <br />Huffines, Public Action in Correction Effort (PACE), who is state director of this organization, <br />(concerned citizens) said his organization plans to establish an office in South Bend and will <br />work with inmates while they are in jail and when they are released. He commended the Work <br />Release program. <br />Those speaking against the resolution were Mr. Richard Trowbridge, 912 S. Gladstone Ave., who <br />objected to the west -side site. Councilman Szymkowiak and Zielinski also objected to the site <br />being on the west side of South Bend. Councilman Allen asked about maintenance on the building. <br />Mr. Cornell stated that concerned South Bend citizens will donate the funds. Councilman Reinke <br />reminded Mr. Cornell this lease is to be renewed again on May 4, 1971. Councilman Craven made a <br />motion for adoption of the Resolution. Councilman Reinke seconded the motion. Motion carried. <br />7 ayes (Councilmen Laven, Allen, Reinke, Craven, Grounds, Wise and Palmer), 2 nays, (Councilmen <br />Szymkowiak and Zielinski), 0 absent. <br />RESOLVE INTO THE COMMITTEE OF THE WHOLE <br />Council President Laven entertained a motion to resolve the Council into the Committee of the <br />Whole on the state of the City to consider the items listed on the agenda for the consideration <br />of the Committee of the Whole. Councilman Allen so moved and Councilman Zielinski seconded the <br />motion. Motion carried. Time: 9:10 p.m. <br />COMMITTEE OF THE WHOLE MEETING <br />Be it remembered that the Common Council of the City of South Bend, Indiana, met in the County - <br />City Building, in the Committee of the Whole, in the Council Chambers on Monday, December 14, 1970 <br />at 9:11 P.M. <br />nRnTNAWrR <br />AN ORDINANCE AMENDING AND SUPPLEMENTING CHAPTER 40 <br />OF THE MUNICIPAL CODE OF SOUTH BEND, INDIANA. (South <br />Side of 3000 Block of Edison Road) <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Mr. Howard Bellinger, Executive Director <br />Area Plan Commission, said the parcel to be rezoned, contained 11.6 acres and 127 units of multipl <br />family type houses were to be constructed. The project will be built around two retention basins <br />which will help relieve flooding conditions in the immediate area. He stated that the Area Plan <br />Commission was recommending it favorable to the Council, from "A "residential to "B" residential <br />zoning. Mr. George Roberts, Attorney for the developers, spoke in their behalf. The developers <br />were reluctant to display architectural drawings of the outside appearance of the proposed <br />structures despite requests from Mr. Ken Granger, 3107 Boynton Ave., South Bend. Mr. S. J. <br />Crumpacker, City Attorney said the Council has jurisdiction for the zoning and site plan of the <br />parcel of land - -not the architectural drawings. Councilman Wise stated,in the past, some develop- <br />ers have submitted drawings and pictures of the proposed structures, then, when the buildings were <br />finished, the homes were entirely different from the pictures. He said he had hoped that the <br />hearing could have been delayed until specifications could have been submitted relating to the <br />sewer, elevations, and.various other technical details of the construction of the proposed units. <br />
