COMMITTEE OF THE WHOLE JANUARY 12, 1970 <br />ORDINANCE <br />AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL <br />CITY OF SOUTH BEND, INDIANA, GENERALLY DESCRIBED <br />AS THE FILLMORE ROAD, MAYFLOWER ROAD, PENN CENTRAL, <br />CITY LIMITS ANNEXATION. <br />This being the time heretofore set for public,hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon, however, because the public portion <br />of the hearing was held on Dec. 8, 1969, and due to Council's decision to postpone the remainder <br />of the hearing, only the Council portion of the Committee of the Whole was conducted on this date. <br />This explanation was given to the audience by Chairman of the Committee of the Whole Meeting, <br />Councilman Grounds. <br />Councilman Allen made a motion to amend the Ordinance to exclude the West portion of the tract, <br />between the railroad tracks and Linden Avenue, from the territory proposed for annexation. She <br />said annexation would be a hardship on the residents and installing the city services and street <br />costs would put a strain on the Street Department. City Engineer Taylor stated this was a defici <br />type of annexation but that these are the areas that need the extra care. Councilman Zielinski <br />seconded Councilman Allen's motion. Motion was defeated by a show of hands vote. 3 ayes, <br />(Councilmen Allen, Wise and Zielinski) Councilman Szymkowiak abstained from voting by stating he <br />was not in favor of any annexation in this area. 5 nays, (Councilmen Laven, Reinke, Grounds, <br />Palmer and Craven). <br />Councilman Laven made a motion, seconded by Councilman Reinke, that the Ordinance go to the <br />Council as favorable. Motion carried. 5 ayes, (Councilmen Laven, Reinke, Craven, Grounds and <br />Palmer) 4 nays, (Councilmen Allen, Wise, Zielinski and Szymkowiak) <br />ORDINANCE <br />AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL <br />CITY OF SOUTH BEND, INDIANA, GENERALLY LYING WEST <br />OF MICHIGAN STREET BETWEEN IRELAND ROAD AND THE <br />BY -PASS. <br />This being the time heretofore set for public hearing on the above Ordinance, g'oponents and <br />opponents were given an opportunity to be heard thereon, Councilman Laven read the following <br />report from the Annexation Committee: <br />To the Common Council of the City of South Bend: <br />Your Committee, The Annexation Committee, to whom was referred "AN ORDINANCE ANNEXING TERRITORY <br />TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, GENERALLY LYING WEST OF MICHIGAN STREET BETWEEN <br />IRELAND ROAD AND THE BY- PASS." respectfully report that they have examined the matter and that <br />in their opinion This area is part of the overall annexation plan of this city, as set forth in <br />the Area Plan Commission study of November, 1966. It is contiguous to the city on two sides. <br />Specific data relating to the area is attached. <br />/s/ Robert 0. Laven <br />Chairman <br />Mr. Roman Kowalski, 802 Birchwood, South Bend, asked if this annexation ordinance complies with <br />the changes made by the State Legislature. City Attorney Crumpacker replied that it does. <br />City Engineer Lloyd Taylor gave the statistical data and physical features of the _area proposed <br />for annexation. It contains 176.9 acres. Mr. Vince Engles, 230 Patterson Dr., South Bend, <br />asked why South Bend was annexing this area. Mr. Engles was one of a group of about 30 Adams <br />High School Civics class attending the meeting. Mr. Taylor explained to the group the reasons <br />for a city annexing territories. <br />Councilman Reinke made a motion that the Ordinance go to the Council as favorable. Councilman <br />Craven seconded the motion. motion carried. <br />ORDINANCE <br />AN ORDINANCE ANNEXING TERRITORY TO THE MUNICIPAL <br />CITY OF SOUTH BEND, INDIANA, WHICH IS COMMONLY <br />DESCRIBED AS LYING NORTH OF KERN ROAD AND EAST <br />OF YORK ROAD. <br />This being the time heretofore set for public hearing on the above Ordinance, proponents and <br />opponents were given an opportunity to be heard thereon. Councilman Laven read a report from <br />the Annexation Committee as follows: <br />To the Common Council of the City of South Bend: <br />Your Committee, The Annexation Committee, to whom was referred "AN ORDINANCE ANNEXING TERRITORY <br />TO THE MUNICIPAL CITY OF SOUTH BEND, INDIANA, WHICH IS COMMONLY DESCRIBED AS LYING NORTH OF <br />KERN ROAD AND EAST OF YORK ROAD," respectfully report that they have examined the matter and <br />that in their opinion, This is a petitioned annexation by Place & Company of approximately 9 acres <br />adjacent to the present Kensington Farms. This area is to be used in conjunction with the <br />petitioners development project in that area, within the scope of the annexation study of the <br />Area Plan Commission of November, 1966. <br />/s/ Robert 0.
