MAI <br />REGULAR MEETING JULY 14, 1969 <br />PETITION <br />PETITION FOR ANNEXATION OF REAL ESTATE <br />27 Acre Tract, Portage <br />North of Fillmore Road <br />West of Lombardy Drive <br />South Bend, Indiana <br />July 8, 1969 <br />To the Honorable Common Council of the City of South Bend, Indiana <br />Neva L. Templeton, your petitioner, respectfully represents and shows: <br />1. The petitioner is the owner in fee simple of the tract of land comprising approxi- <br />mately twenty -seven (27) acres in the Southeast Quarter of the Southeast Quarter of Section 5, <br />Township 37 North, Range 2 East in Portage Township, St. Joseph County, Indiana, which tract <br />is situated West of Lombardy Drive and North of Fillmore Road and is situated outside the corpor- <br />ate boundaries of the civil city of South Bend but adjacent thereto, and which is more partic- <br />ularly described as follows: <br />A part of the Southeast 1/4 of the Southeast 1/4 of Section 5, Township 37 <br />North, Range 2 East located in St. Joseph County, Indiana, more particularly <br />described as follows: <br />Beginning at the Southeast corner of said Section 5, thence North along the <br />East line of said Section 5, 986.2 feet; thence West 1319.87 feet to the <br />West line of said Southeast 1/4 of the Southeast 1/4 of Section 5, said <br />line being also the East line of the recorded plat of Portage Gardens, an <br />addition recorded in the office of the County Recorder of St. Joseph County, <br />Indiana; thence South along said East line of Portage Gardens, 988.71 feet <br />to the South line of said Section 5; thence East along said South line of <br />Section 5, 481:feet, thence North parallel with said West line of the South- <br />east 1/4 of the Southeast 1/4, 476 feet; thence East parallel with said South' <br />line of Section 5, 260 feet; thence South parallel with said West line of <br />the Southeast 1/4 of the Southeast 1/4, 476 feet to the South line of said <br />Section 5; thence East along said South line of Section 5, 582.1 feet to the <br />place of beginning. <br />2. Petitioner desires that said tract of land be annexed to and become a part of <br />the civil city of South Bend. <br />WHEREFORE, petitioner respectfully requests that all requisite procedure be undertaken <br />and pursued to the adoption of an ordinance annexing said real estate to the civil city of <br />South Bend. <br />Is/ Neva L. Nimitz and John Montgomery <br />Councilman Allen made a motion that the petition be placed in the Annexation Committee and <br />simultaneously forwarded to the Area Plan Commission for their study and recommendations, which <br />recommendations are to be redirected to the Annexation Committee for a report to the Council. <br />Councilman Wise seconded the motion.
