<br />Kathy Cekanski - Farrand, Council Attorney, indicated that it was important to point out the
<br />six standards when reviewing Bill No. 30 -80, which are: 1. Are the parking restrictions
<br />reasonably related to the public health, safety, and welfare? 2. Are the restrictions
<br />reasonably related to the traffic and pedesterian safety? 3. Is the language clear and
<br />understandable? 4. Is the bill in the best interests of the community as a whole? 5,. Do
<br />the remonstrators present clear and convincing evidence that the bill is arbitrary and
<br />capricious, and that it has no substantial relation.'. to the public health, safety, and welfare.
<br />6. Is the bill enforceable? Council Member Dombrowski indicated there was nothing in this
<br />bill that would hurt the'RV industry. Council President McGann, indicated he felt there was
<br />sufficient votes to pass this bill, but he was willing to delay it for more study. He said
<br />he would like to ask Mr. Gilligan, spokesman for the Indiana Manufactured Housing Association,
<br />Mr. Blackmond, their attorney, and Mr. Miller, to assign a member -to work with the Council
<br />in further study of this bill. He made a motion to refer this bill to the Public Works
<br />Committee, seconded by Council Member Kopczynski The motion carried.
<br />Council Member Taylor made a motion to recess, seconded by Council Member Kopczynski. The
<br />motion carried and the meeting was recessed at 8:26 p.m., and reconvened at 8:41 p.m.
<br />BILL NO. 38 -80
<br />A BILL AMENDING CHAPTER 13, ARTICLE 4, SECTION 13 -57 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, IDNIANA, BY THE
<br />ADDITION OF A NEW SUB - SECTION (c) WHICH WOULD PERMIT THE BOARD
<br />OF PUBLIC WORKS TO ISSUE ANNUAL PERMITS TO ALLOW NON - COMMERCIAL
<br />MUSIC IN PUBLIC AREAS.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponen
<br />were given an opportunity to be heard. Mr. Roland Kelly, Vice President of the St. Joseph Bank,,
<br />made the presentation for the bill. He said the bank would like to install carillon bells on
<br />the roof of their building. He said they planned to play these at 9:00 a.m., 12 noon and
<br />5:00 p.m. He said in addition they proposed to provide various pieces of music depicting the
<br />weather, holiday music, appropriate ethnic selections, and such things as the Notre Dame
<br />Victory March at appropriate times. He said the bank guarantees that the use of the bills_
<br />will not be overdone and will never be used for any commercial purpose. He said the music
<br />will be provided as a public service. Council Member Kopczynski made a motion to recommend
<br />this bill to the Council favorable, seconded by Council Member Dombrowski. The motion carried.
<br />BILL NO. 39 -80
<br />A BILL APPROPRIATING $25,000.00 FROM THE LOCAL ROAD AND STREET
<br />FUND TO PROJECT R &S 8001, EDISON ROAD FROM 'STATE ROAD 23 TO
<br />IRONWOOD.
<br />This being the time heretofore set for public hearing on the above bill, proponents and op-
<br />ponents were given an opportunity to be heard. Mr. Patrick McMahon, Director of Public Works,
<br />made the presentation for the bill. He indicated this section of roadway was very narrow and
<br />is presently the only undeveloped roadway on Edison. He said the purpose of this appropriation
<br />is to fund the engineering work necessary to design a four -lane roadway. Council Member Taylor
<br />made a motion to recommend this bill to the Council favorable, seconded by Council Member
<br />Dombrowski. The motion carried.
<br />BILL NO. 40 -80
<br />A BILL APPROPRIATING $1,517.00 FROM THE DISCOVERY HALL FUND OF
<br />THE CITY OF SOUTH BEND, INDIANA, FOR RENTAL OF STORAGE SPACE FOR
<br />THE STUDEBAKER COLLECTION TO BE ADMINISTERED BY THE DEPARTMENT OF
<br />ADMINISTRATION AND FINANCE.
<br />This being the time heretofore set for public hearing on the above bill, proponents and op-
<br />ponents were given an opportunity to be heard. Mr. Joseph Kernan, City Controller, introduced
<br />Mr. Gust Saros, Director of Discovery Hall, who made the presentation for the bill. He in-
<br />dicated this appropriation will cover the first- quarter rent of the space leased to store the
<br />Studebaker vehicle collection, as well as the Studebaker records. Council Member Serge made
<br />a motion to recommend this bill to the Council favorable, seconded by Council Member Taylor.
<br />The motion carried.
<br />There being no further business to come before the Committee of the Whole, Council Member
<br />Dombrowski made a motion to rise and report to the Council and recess, seconded by Council
<br />Member Kopczynski. The motion carried.

<br />AND APPROVING RESOLUTION NO. 10 -80 OF THE SOUTH BEND ECONOMIC
<br />DEVELOPMENT COMMISSION PERTAINING TO MARION W. DUNN.
<br />This bill had second reading. Council Member Taylor made a motion to pass this bill,seconded
<br />by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes.
