<br />BILL NO. 77 -77
<br />A BILL APPROVING THE FORM AND TERMS OF LEASE AND TRUST
<br />INDENTURE AND INDUSTRIAL DEVELOPMENT REVENUE BONDS, AND
<br />AUTHORIZING THE EXECUTION THEREOF PERTAINING TO GRIFFIN'S
<br />OUTBOARD MARINE, INC.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent
<br />were given an opportunity to be heard. Mr. Kenneth Fedder, attorney for the Economic Developmen
<br />Commission, made the presentation for the bill. He said this was an expansion of an existing
<br />operation in the City. He asked that the bill be amended from $400,000 to $50.0,000. Council
<br />Member Adams made a motion to amend this bill, seconded by Council Member Dombrowski. The motio
<br />carried. He said this would mean additional employment and tax base for the community. Council
<br />Member Taylor made a motion to recommend this bill to the Council favorable, as amended, seconde
<br />by Council Member Szymkowiak. The motion carried.
<br />BILL NO. 66 -77
<br />A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED,
<br />COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY
<br />OF SOUTH BEND, INDIANA (CHAPTER 21, MUNICIPAL CODE)
<br />(A 2.6 ACRE PARCEL OF GROUND LOCATED ON THE NORTH
<br />SIDE OF THE INTERSECTION OF MONROE STREET AND
<br />LINCOLN WAY WEST).
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent
<br />were given an opportunity to be heard. Mr. Tim Eckerle, of Area Plan, made the presentation for
<br />the bill. He said this rezoning was for Block Six to change from "B" Residential to "A -3" High
<br />Density Residential Office and Professional District, "G" Height and Area. Council Member Adams
<br />made a motion-to recommend this bill to the Council favorable, seconded by Council Member
<br />Dombrowski. The motion carried.
<br />BILL NO. 74 -77 A BILL TO ELIMINATE RESTRICTED REFUSE COLLECTORS LICENSES
<br />BY AMENDING CHAPTER 15, ARTICLE 4, OF THE MUNICIPAL CODE
<br />OF THE CITY OF SOUTH BEND, INDIANA, SECTIONS 16 -27, 16 -28
<br />AND 16 -29.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent;
<br />were given an opportunity to be heard. Mr. David Wells, Manager of Administration and Design,
<br />made the presentation for the bill. He said the purpose of this bill was to take the small
<br />pick -up trucks that litter, off the road. He said this bill was meant to address the trucks
<br />that pick up in residential districts. Council Member Kopczynski indicated that the problem
<br />with deleting restricted licenses was the removal of bulk items. He said there was nothing
<br />wrong with the present ordinance, but it was not being enforced. Council Member Serge asked how
<br />many of these licenses have been checked. Mr. Peter Mullen, City Controller, indicated that
<br />they have issued thirty -eight restricted licenses. He said a list of those that had not pur-
<br />chased licenses this year had been turned over to Chief Borkowski to be checked out. Council
<br />Member Szymkowiak asked who checked the equipment before a license was issued. Mr. Mullen in-
<br />dicated that Mr. Klebosits at the MSF facility does the inspection. Council Member Szymkowiak
<br />indicated that he would recommend that the police enforce the ordinance. Council Member Dom-
<br />browski indicated that the trucks are not using tarps, and this should be enforced. Council
<br />Member Adams made a motion to recommend this bill to the Council unfavorable, seconded by Counci:
<br />Member Parent. The motion carried, with Council Member Szymkowiak opposing.
<br />BILL NO. 76 -77
<br />A BILL REPEALING ORDINANCE NO. 5339 -71, PASSED SEPTEMBER 27,
<br />1971, WHICH ANNEXED TO THE MUNICIPAL CITY OF SOUTH BEND,
<br />INDIANA, CERTAIN TERRITORY DESCRIBED AS LYING GENERALLY WEST
<br />OF HICKORY ROAD, SOUTH OF THE TOLL ROAD, EAST OF IVY ROAD,
<br />AND NORTH OF THE PRESENT CITY LIMITS, AS AMENDED, AND COM-
<br />MONLY.KNOWN AS MAPLE LANE.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponent
<br />were given an opportunity to be heard. Council Member Taylor, made the presentation for the
<br />bill. He said this annexation falls in the same category as Gilmer Park, and that annexation
<br />was repealed not too long ago. He indicated that this annexation has been in court for six year
<br />He said from the very beginning it was questionable as to whether Maple Lane would serve any
<br />benefit to South Bend. He said the City has failed to win the case in court, and if we would
<br />allow Maple Lane to become a part of the City we actually would be putting the citizens of South
<br />Bend in the position of subsidizing people who live in Maple Lane. Council Member Adams made a
<br />motion to recommend this bill to the Council favorable, seconded by Council Member Taylor. The
<br />motion carried, with Council Member Miller opposing.
<br />BILL NO. 79 -77 A BILL APPROVING A CONTRACT BETWEEN THE BUREAU OF WATER OF
<br />THE CITY OF SOUTH BEND, INDIANA, AND (1) CLOW CORPORATION,
<br />SOUTH BEND, INDIANA, (2) KENNEDY VALVE MANUFACTURING COMPANY,
<br />ELMIRA, NEW YORK, AND (3) MUELLER CO., CHATTANOOGA, TENNESSEE,
<br />FOR THE PURCHASE OF AN ASSORTMENT OF WATER MAIN, VALVES, FITTINGS,
<br />AND HYDRANTS IN THE AMOUNT OF $207,914.42.
<br />This being the time heretofore set for public hearing on the above bill, proponents and opponen
<br />were given an.opportunity to be heard. Mr. Bill Dillon, engineer for the Water Works, made the
<br />presentation for the bill. He said bids were let pursuant to the statutes of the State of Indi
<br />and were found competitive. Council Member Adams asked if the prices were comparable to last
<br />year. Mr. Dillon indicated they were almost the.same. Council Member Szymkowiak made a motion
<br />to recommend this bill to the Council favorable, seconded by Council Member Taylor. The motion
<br />carried.
