<br />Council Member Beck made a motion to resolve into the Committee of the Whole, seconded
<br />by Council Member Taylor. The motion carried.
<br />COMMITTEE OF THE WHOLE
<br />Be it remembered that the Common Council of the City of South Bend met in the Committee
<br />of the Whole on August 9, 1982, at 7:12 p.m., with nine members present. Chairman
<br />Voorde presiding.
<br />BILL NO. 60 -82 A BILL AMENDING ORDINANCE NO. 4990 -68, AS
<br />AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE
<br />OF THE CITY OF SOUTH BEND, INDIANA (CHAPTER
<br />21, MUNICIPAL CODE) (IRONWOOD AND WILSON.)
<br />Now is the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. David Anderson, Associate Administrator
<br />of Osteopathic Hospital, indicated that in deference to the residents in the area of
<br />the hospital, they would like to develop an alternate parking plan. He asked that
<br />this petition be withdrawn. Council Member McGann made a motion to strike this
<br />bill, seconded by Council Member Taylor. The motion carried.
<br />BILL NO. 78 -82 A BILL AMENDING ORDINANCE NO. 4990 -68, AS AMENDED, COMMONLY
<br />KNOWN AS THE ZONING ORDINANCE OF THE CITY OF SOUTH BEND,
<br />INDIANA (CHAPTER 21, MUNICIPAL CODE) (INWOOD AND IRONWOOD.)
<br />Now is the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. David Behr, from Area Plan, made
<br />the presentation for the bill. He indicated this property was recently annexed to
<br />the City, and it contains a portion of the St. Paul Retirement Center and the City's
<br />retention basin. He indicated that when it was annexed the zoning was A residential,
<br />and it was necessary to rezone this to B residential. Council Member Taylor made a
<br />motion to recommend this bill to the Council favorable, seconded by Council Member
<br />McGann. The motion carried.
<br />BILL NO. 79 -82
<br />A BILL OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
<br />INDIANA, AMENDING VARIOUS SECTIONS OF CHAPTER 4 OF THE
<br />MUNICIPAL CODE OF THE CITY OF SOUTH BEND, INDIANA, COMMONLY
<br />KNOWN AS LICENSES, AND BY THE ADDITION OF SECTION 4 -42
<br />ENTITLED PARAPHERNALIA.
<br />Now is the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Council President McGann made a
<br />motion�to amend this bill, in accordance with amendments filed with the City Clerk,
<br />seconded by Council Member Taylor. The motion carried. Council President McGann
<br />made the presentation for the bill. He indicated that Michael Barnes the County
<br />Prosecutor, had requested that the municipalities enact ordinances which would strictly
<br />regulate and control drug - related paraphernalia. Kathleen Cekanski - Farrand, Council
<br />Attorney, indicated that the Supreme Court held that a City or town can legally
<br />license drug paraphernalia. She indicated that the Council cannot prohibit the sale
<br />of paraphernalia. She indicated that this bil would require licensing, to try and
<br />discourage the sale of drug - related materials. Council Member Beck made a motion to
<br />recommend this bill to the Council favorable, as amended, seconded by Council Member
<br />Harris. The motion cariied.
<br />BILL NO. 82 -82
<br />A BILL AMENDING THE EFFECTIVE DATE OF ORDINANCE NO. 7058-
<br />82, COMMONLY KNOWN AS AUTOMOTIVE REPAIR AND SERVICE CENTERS.
<br />Now is the time heretofore set for public hearing on the above bill, proponents and
<br />opponents were given an opportunity to be heard. Council Member Crone made the
<br />presentation for the bill. She indicated this bill would change the effective date
<br />of the Automotive and Service Centers licensing ordinance from August 15 to September
<br />2,1982, Council Member McGann made a motion to recommend this bill to the Council
<br />favorable, seconded by Council Member Zielsinki. The motion carried.
<br />There being no further business to come before the Committee of the Whole, Council
<br />Member Beck made a motion to rise and report to the Council, seconded by Council
<br />Member Zielsinki. The motion carried.
