7 REGULAR MEETING APRIL 26, 1982 ATTEST: L."_ i erk C y BILLS, SECOND READING ORDINANCE NO. 7044 -82 ATTEST: Chair an AN ORDINANCE APPROPRIATING $11,000 FROM THE FEDERAL ASSIS- TANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR THE 1982 SUMMER ENVIRONMENTAL CLEAN -UP PROGRAM. This bill had second reading. Council Member Serge made a motion to pass this bill, seconded by Council Member Dombrowski. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7045 -82 AN ORDINANCE APPROPRIATING $1,500,000.00 FROM THE FEDERAL ASSISTANCE GRANT, COMMONLY REFERRED TO AS GENERAL REVENUE SHARING FOR 1982 POLICE AND FIRE PENSION COSTS TO BE ADMIN- ISTERED BY THE DEPARTMENT OF ADMINISTRATION AND FINANCE OF THE CITY OF SOUTH BEND, INDIANA. This bill had second reading. Council Member Szymkoiwak made a motion to pass this bill, seconded by Council Member Taylor. The bill passed by a roll call vote of nine ayes. ORDINANCE NO. 7046 -82 AN ORDINANCE ON TRANSFERRING AND APPROPRIATING $125,000 FROM CUMULATIVE CAPITAL IMPROVEMENT FUND TO THE BOARD OF PUBLIC WORKS WITHIN THE GENERAL FUND OF THE CITY OF SOUTH BEND, INDIANA. This bill had second reading. Council Member Taylor made a motion to pass this bill, seconded by Council Member Serge. The bill passed by a roll call vote of nine ayes. RESOLUTIONS RESOLUTION NO. 953 -82 A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOL- UTION DESIGNATING 404 WEST SAMPLE STREET AN URBAN DEVELOP- MENT AREA FOR TANGIBLE PERSONAL PROPERTY TAX ABATEMENT PUR- POSES AND A DETERMINATION OF THE PUBLIC UTILITY AND BENEFIT OF THE PROPOSED PROJECT. WHEREAS, the Common Council of the City of South Bend, Indiana, has adopted a Declaratory Resolution designating certain areas within the City as Urban Development Areas for purposes of tax abatement consideration; and WHEREAS, a Declaratory Resolution designating the area commonly known as 404 West Sample Street, South Bend, Indiana, and more particularly described by a line drawn as follows: A parcel of land being a part of the Northeast Quarter of Section 14, Township 37, North, Range 2 East of the Second Principal Meridan and being more parti- cularly described as follows, viz: Beginning at a point 1200.01 feet South 890- 51' -46" East of the Northwest corner of Tract No. 4 of the Studebaker Corporation Replat as recorded in Plat Book 11, page 184, in the office of the Recorder of St. Joseph County, Indiana, said point being on the North Line of said Tract No. 4, which North Line is also the South right -of -way line of Sample Street; thence South 00- 21' -18" East along the projection of a wall line and along said wall line, a distance of 421.71 feet to an angle point; thence South 270- 52' -38" East, along a wall line a distance of 127.07 feet to an angle point; thence North 890- 38' -42" East, along a wall line a distance of 132.73 feet to a point 96.19 feet South 890- 38' -42" West of the West right -of -way line of Franklin Street; thence South 00- 21' -55" East, paral- lel with the West right -of -way line of Franklin Street, a distance of 160.27 feet to a point 96.18 feet South 890- 55' -21" West of said West right -of -way line of Franklin Street; thence North 890- 55' -21" East, a distance of 96.18 feet to said West right -of -way line; thence North 00- 21' -55" West, along said West right -of -way line, a distance of 604.93 feet said South right -of -way line of Sample SStreet; thence North 890- 51' -46" West, along said South right -of -way line, a distance of 241.64 feet to the place of beginning. Containing 122,878.47 square feet (2.821 acres) more or less. is an Urban Development Area; and WHEREAS, the Area Plan Commission has submitted to the Council its written order approving the Declaratory Resolution to the Council; and WHEREAS, notice of the adoption of a Declaratory Resolution and the public hear- ing before the Council having been published pursuant to Indiana Code 36- 7- 14 -17; and WHEREAS, the Council held a public hearing for the purposes of hearing persons in favor of the proposed project and those remonstrators who were opposed to the proposed project; and
