REGULAR MEETING_ <br />JANUARY 91 1984 <br />BILL NO. 134 -83 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE <br />EAST WEST ALLEY IN THE HALF BLOCK BOUNDED BY SOUTH BEND <br />AVENUE ON THE NORTH, CEDAR STREET ON THE SOUTH, ST. LOUIS <br />STREET ON THE EAST AND THE NORTH -SOUTH ALLEY APPROXIMATELY <br />HALF WAY BETWEEN SOUTH BEND AVENUE AND CEDAR STREET ON THE <br />WEST, ALL LOCATED IN BULLA'S ADDITION TO THE TOWN OF LOWELL, <br />NOW A PART OF THE CITY OF SOUTH BEND, IN ST. JOSEPH COUNTY, <br />INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Council Member Voorde made a <br />motion to amend Bill No. 134 -83 by amending present Section V to read Section VI, and <br />amending Section V to read as follows: Passage of this ordinance is conditioned upon <br />the petitioner filing a proper legal document with the Board of Public Works dedicating <br />a six by fifty -four foot parcel as a permanent easement and right -of -way., seconded <br />by Council Member Taylor. The motion carried. John Ford, attorney for the petitioner, <br />made the presentation for the bills. He indicated the purpose of this vacation is to <br />allow Saint.Joseph's Medical Center to provide adequate parking for two physicians' <br />office buildings in the immediate vicinity. John Blower, employee of St. Joseph <br />Medical Center spoke in favor of this bill. Council Member Voorde made a motion to <br />recommend Bill No. 133 -84 to the Council favorable, seconded by Council Member Taylor. <br />The motion carried. Council Member Voorde made a motion to recommend Bill No. 134- <br />83, as amended, to the Council favorable, seconded by Council Member Taylor. The <br />motion carried. <br />Council Member Puzzello made a motion to combine public hearing on bill nos. 139 and <br />140 -83, seconded by Council Member Taylor. The motion carried. <br />BILL NO. 139 -83 A BILL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ORDINANCE <br />NO. 7230 -83 AUTHORIZING THE ISSUANCE AND SALE OF BONDS OF <br />SAID CITY IN ORDER TO PROVIDE FUNDS FOR PAYMENT OF JUDGMENTS <br />AGAINST THE CITY. <br />BILL NO. 140 -83 <br />A BILL OF THE CITY OF SOUTH BEND, INDIANA, AMENDING ORDINANCE <br />NO. 7231 -83 AND APPROPRIATING THE SUM OF ONE HUNDRED SEVENTY <br />THOUSAND DOLLARS ($170,000.00) FOR PAYMENT OF JUDGMENTS <br />AGAINST THE CITY. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Joseph Kernan, City Controller, <br />made the presentation for the bills. He indicated that earlier this year the Council <br />passed a similar bill in the amount of $155,000 to pay these same judgments, but <br />delay on final approval by the State Board of Tax Commissioners negatively affected <br />he marketability of the bonds. He indicated that post - judgment interest has also <br />continued to accrue and now $270,000 is required to meet the City's obligations. <br />Council Member Beck made a motion to recommend Bill No. 139 -83 to the Council favorable, <br />seconded by Council Member Taylor. The motion carried. Council Member Beck made a <br />motion to recommend Bill No. 140 -83 to the Council favorable, seconded by Council <br />Member Taylor. The motion carried. <br />There being no further business to come before the Committee of the Whole, Council <br />Member Taylor made a motion to rise and report to the Council, seconded by Council <br />Member Beck. PETER STREET ON <br />THE EAST AND ST. LOUIS STREET ON THE WEST, ALL LOCATED IN M. <br />E. LISTENBERGER'S SUBDIVISION OF LARGE LOT OR BLOCK NUMBERED <br />THREE (3) IN SAMUEL CONTTRELL'S FIRST ADDITION TO THE TOWN <br />OF LOWELL, NOW A PART OF THE CITY OF SOUTH BEND, IN ST. <br />JOSEPH COUNTY, INDIANA. <br />This bill had second reading. Council Member Taylor made a motion to pass this bill, <br />seconded by Council Member Serge. The bill passed by a roll call vote of nine ayes. <br />
