REGULAR MEETING MAY 28 2013 162 <br />to Mayor Pete Buttigieg giving official notice that Teamster Local Union No. 364 desires to <br />negotiate changes and modifications to the Agreement Between the City of South Bend and <br />Teamsters Local Union No. 364 ("Agreement") which expires on December 31, 2013; and <br />WHEREAS, the South Bend Common Council, which is the body authorized to approve <br />a contract between the City and Teamster Local Union No. 364, is expected to adopt a resolution <br />at its meeting of May 27, 2013, appointing a negotiator for the purpose of reaching a new <br />agreement with Teamster Local Union No. 364 through the negotiating process, related to such <br />items as working conditions and other such items addressed in the Agreement; and <br />WHEREAS, the South Bend Common Council has the authority to approve wages and <br />budgetary items addressed in the Agreement; and <br />WHEREAS, the Board of Public Works hereby wishes to act in unity with the South <br />Bend Common Council for the purpose of reaching a new agreement with Teamster Local Union <br />No. 364, through the negotiating process, related to such items as annual compensation and other <br />budgetary items addressed in the Agreement; and <br />WHEREAS, the Board of Public Works, in agreement with the South Bend Common <br />Council, wishes to appoint a negotiator to address wages and other budgetary items addressed in <br />the Agreement; and <br />WHEREAS, the negotiator appointed by the Board of Public Works, together with any <br />persons named by the negotiator to act in an advisory capacity to the negotiator shall not be <br />considered a "Governing body" or "public agency" under either Indiana Code 5-14-1.5-2 or 5- <br />14-3-1. { <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF <br />THE CITY OF SOUTH BEND, INDIANA, as follows: <br />1. The Board of Public Works of the City of South Bend, Indiana hereby appoints Cheryl <br />A. Greene as its negotiator in any discussions with Teamster Local Union No. 364 concerning <br />wages and other budgetary items addressed in any agreement with Teamster Local Union No. <br />364. <br />2. Cheryl A. Greene shall have the authority to appoint a team to advise her and shall <br />keep the Board of Public Works advised of the composition of that team. <br />3. Martin, Clerk <br />ADOPT RESOLUTION NO. 34-2013 — A RESOLUTION OF THE SOUTH BEND BOARD <br />OF PUBLIC WORKS APPROVING THE TRADE-IN OF CITY -OWNED PROPERTY ON <br />PROPERTY OF SIMILAR NATURE <br />Upon a motion made by Ms. Roos, seconded by Mr. Relos and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO.34-2013 <br />A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS <br />APPROVING THE TRADE-IN OF CITY -OWNED PROPERTY <br />ON PROPERTY OF SIMILAR NATURE <br />WHEREAS, it has been determined by the Board of Public Works of the City of South Bend that <br />the following described property is unfit for the purpose for which it was intended and should be traded -in <br />for property of a similar nature: <br />
