REGULAR MEETING MAY 28, 2013 163 ONE (1) 1998 FORD JET RODDER VACUUM VIN NO. 1FDYN80E8WVA39358 WHEREAS, I.C. 36- 1 -11 -9 authorizes the Board of Public Works to trade in or exchange City -owned property for partial or full reduction in the purchase price of property of similar nature. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, AS FOLLOWS: I. Martin, Clerk ADOPT RESOLUTION NO. 35 -2013 - A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND INDIANA REGARDING THE SALE OF CERTAIN PROPERTY TO THE CITY OF SOUTH BEND BUILDING CORPORATION Upon a motion made by Mr. Relos, seconded by Ms. Roos and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO. 35-2013 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, INDIANA, REGARDING THE SALE OF CERTAIN PROPERTY TO THE CITY OF SOUTH BEND BUILDING CORPORATION WHEREAS, the City of South Bend, Indiana (the "City "), has previously executed a lease (the "Lease ") whereby the City shall lease (i) a fire station facility to replace the existing Fire Station #5 located at 2221 Prairie Avenue in the City (the "Fire Station Property"); and (ii) a fire safety training facility located generally on a 5.5 acre parcel near Sample and High Streets in the City (the "Fire Training Center Property" and with the Fire Station Property, the "Property ") in the City (collectively, the "Project ") from the City of South Bend Building Corporation (the `Building Corporation "); and WHEREAS, construction of the Project is to be financed by the Building Corporation through the issuance of its first mortgage bonds; and WHEREAS, the City desires to sell Property to the Building Corporation, said Property being described as set forth in the Lease; and WHEREAS, the Board of Public Works of the City (the "Board ") previously approved the appointment of two (2) appraisers professionally engaged in making appraisals to appraise the Fire Station Property and certain parcels of the Fire Training Center Property (the "Appraised Fire Training Center Property ") which include those parcels not acquired by the City within three (3) years prior to the date of appointment of said appraisers; and WHEREAS, the average of the two (2) appraisals equals Twenty -three Thousand and 00/100 Dollars ($23,000.00) for the Fire Station Property and One Hundred Seventy -Eight
