REGULAR MEETING MAY 28, 2013 163 <br />ONE (1) 1998 FORD JET RODDER VACUUM <br />VIN NO. 1FDYN80E8WVA39358 <br />WHEREAS, I.C. 36-1-11-9 authorizes the Board of Public Works to trade in or exchange <br />City -owned property for partial or full reduction in the purchase price of property of similar nature. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE <br />CITY OF SOUTH BEND, AS FOLLOWS: <br />I. Martin, Clerk <br />ADOPT RESOLUTION NO. 35-2013 - A RESOLUTION OF THE BOARD OF PUBLIC <br />WORKS OF THE CITY OF SOUTH BEND 1NDIANA REGARDING THE SALE OF <br />CERTAIN PROPERTY TO THE CITY OF SOUTH BEND BUILDING CORPORATION <br />Upon a motion made by Mr. Relos, seconded by Ms. Roos and carried, the following Resolution <br />was adopted by the Board of Public Works: <br />RESOLUTION NO.35-2013 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS <br />OF THE CITY OF SOUTH BEND, INDIANA, <br />REGARDING THE SALE OF CERTAIN PROPERTY TO THE <br />CITY OF SOUTH BEND BUILDING CORPORATION <br />WHEREAS, the City of South Bend, Indiana (the "City"), has previously <br />executed a lease (the "Lease") whereby the City shall lease (i) a fire station facility to replace the <br />existing Fire Station #5 located at 2221 Prairie Avenue in the City (the "Fire Station Property"); <br />and (ii) a fire safety training facility located generally on a 5.5 acre parcel near Sample and High <br />Streets in the City (the "Fire Training Center Property" and with the Fire Station Property, the <br />"Property") in the City (collectively, the "Project") from the City of South Bend Building <br />Corporation (the `Building Corporation"); and <br />WHEREAS, construction of the Project is to be financed by the Building <br />Corporation through the issuance of its first mortgage bonds; and <br />WHEREAS, the City desires to sell Property to the Building Corporation, said <br />Property being described as set forth in the Lease; and <br />WHEREAS, the Board of Public Works of the City (the "Board") previously <br />approved the appointment of two (2) appraisers professionally engaged in making appraisals to <br />appraise the Fire Station Property and certain parcels of the Fire Training Center Property (the <br />"Appraised Fire Training Center Property") which include those parcels not acquired by the City <br />within three (3) years prior to the date of appointment of said appraisers; and <br />WHEREAS, the average of the two (2) appraisals equals Twenty-three Thousand <br />and 00/100 Dollars ($23,000.00) for the Fire Station Property and One Hundred Seventy -Eight <br />
