or greater. <br />e. Performing a Safety -Sensitive Function while under the influence of any Drug. <br />f. PCC prohibits the use of any Controlled Substance or any other Drug that cannot be <br />substantiated by medical evidence (i.e., a prescription) of legitimate therapeutic use. <br />a. If a Covered Employee is taking a prescription drug, the Employee must notify Human <br />Resources: <br />i. If the prescription drug may alter their ability to perform Safety -Sensitive <br />Functions; and/or <br />ii. If the prescription for any drugs the employee is using indicates that one should <br />not drive, operate machinery, or engage in hazardous activities. <br />g. In the event that a Covered Employee's Test for Controlled Substances comes back <br />positive due to a prescription drug, it shall be the Covered Employee's responsibility to <br />provide the MRO with proof of a valid prescription in order for test results to be ruled <br />negative. <br />h. Use of Alcohol <br />b. An employee will be removed from performing a Safety -Sensitive Function: <br />i. When the results of an Alcohol Test indicate an alcohol concentration of 0.02 or <br />greater; or <br />ii. If the employee <br />1. Refuses to submit to required Alcohol Tests. <br />2. Is in possession of alcohol while driving; or <br />3. Is under the influence of or impaired by alcohol, as indicated by <br />behavior, speech and performance indicators of alcohol misuse, and a <br />Reasonable Suspicion Test for alcohol cannot be obtained. <br />i. Covered Employees are prohibited from unlawfully manufacturing, distributing, <br />dispensing, or possessing, Drugs or alcohol, in the workplace, or while on the job, <br />except that possession of prescription medications covered by a valid prescription is <br />permitted. Additionally, an employee who is convicted of a drug or alcohol offense <br />which occurred in the workplace must notify their supervisor within 5 days. <br />j. Violation of this Policy, including a positive result on a Test for Controlled Substances <br />or an Alcohol Test, may result in immediate disciplinary action up to and including <br />termination. <br />5. Pre -employment Testing <br />a. A Pre -Employment Test will be conducted when: <br />i. An applicant is selected to be hired for a position covered by this Policy. <br />91 <br />
