of illegal substances, drugs, stolen property, and other illegal acts may result in notification of the <br />proper law enforcement agencies. <br />Employees (and applicants) subject to federal drug testing regulations (e.g., employees in safety <br />sensitive jobs or employees working on DOT -funded projects) will be tested pursuant to those <br />regulations, as well as this Fitness for Duty policy. PCC reserves the right to amend this Policy at <br />its sole discretion or as necessary to comply with contract requirements, union agreements, local, <br />state, or federal laws. PCC further reserves the right to change the testing limits and panel <br />procedures as advances in technology or other considerations warrant identification of the named <br />substances or additional substances in different concentrations or through different screening <br />techniques. <br />PCC recognizes that chemical dependency is a serious health problem and encourages all <br />employees to seek assistance for such problems prior to becoming subject to discipline under this <br />or other PCC policies. Reasonable efforts will be made to provide any accommodation requested <br />by an employee. Such requests will not excuse employees from future compliance with PCC <br />standards of conduct or performance. Appropriate procedures have been established to maintain <br />strict confidentiality. <br />Employees are responsible for conducting all aspects of their employment in compliance with the <br />Fitness for Duty Policy. All employees hired are required to sign the Acknowledgement, Consent, <br />and Agreement to Comply form as a condition of employment. <br />1. Definitions <br />a. Alcohol Test — Tests for breath alcohol concentration conducted utilizing a National <br />Highway Traffic Safety Administration (NHTSA)-approved testing device, which <br />appears on ODAPC's Web page as an approved device as set forth in 49 CFR Part <br />40, operated by a trained technician. If the initial test indicates an alcohol <br />concentration of 0.02 or greater, a second test will be performed to confirm the <br />results of the initial test. The confirmatory test will be performed using a NHTSA- <br />approved evidential breath testing device (EBT) operated by a trained breath alcohol <br />technician (BAT). The EBT will identify each test by a unique sequential identification <br />number. This number, time, and unit identifier will be provided on each EBT printout. <br />The EBT printout along with an approved alcohol testing form will be used to <br />document the test, the subsequent results, and to attribute the test to the correct <br />employee. The test will be performed in a private, confidential manner as required <br />by 49 CFR Part 40, as amended. The procedure will be followed as prescribed to <br />protect the employee and to maintain the integrity of the alcohol testing procedures <br />and validity of the test result. <br />b. Applicant — Any person requesting employment with PCC <br />c. Benefits: Health, life, disability, leave, or other similar programs sponsored by PCC for the <br />exclusive use of its employees. <br />d. PCC: PCC, any affiliate or subsidiary of PCC Construction Group, LLC, or any Joint <br />Venture in which PCC or a subsidiary or affiliate participates. <br />e. PCC Property: Any property owned, rented, leased, or used by PCC for business purposes <br />including, but not limited to, construction sites, parking lots and vehicles, buildings, and <br />21 P egg; <br />
