�.. - <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Kevin Joyce, of Area Plan, <br />gave the staff report, which was favorable. Rick Morgan, attorney, indicated the <br />petitioner planned to build approximately 120 storage units. He indicated the area <br />would be property screened. He indicated that under the current City zoning <br />ordinance mini warehousing must be classified as "D" light industrial. Patricia <br />Lynch 23365 Grant Road, spoke against this rezoning. She indicated this was a <br />residential area. Bob , 5414 W. Sample, indicated he would encourage retail <br />development, but not "D" light industrial. Valarie Malecki, Sylvan Lane, and Virgil <br />Lynch, 23665 Grant Road, spoke against this zoning. Council Member Zakrzewski <br />indicated he felt the best zoning for this tract would be commercial. He made a <br />motion to recommend this bill go to Council unfavorable, seconded by Council Member <br />Barcome. The motion failed on a roll call vote of four ayes and five nays (Council <br />Members Braboy, Beck, Taylor, Voorde and Serge.) Council Member Taylor made a <br />motion to recess, seconded by Council Member Beck. The motion carried and the <br />meeting was recessed at 8:08 p.m., and reconvened at 8:20 p.m. Council Member <br />Voorde made a motion that this bill be recommended to Council favorably, with the <br />following amendment: In Section I, strike the period and add the following: <br />excepting herefrom the northern one hundred and sixty feet (160') of said parcel <br />which shall be established as C- Commercial, A- Height and area. Add a new Section II <br />to read: This rezoning ordinance is subject to the petitioner recording in the <br />Recorder's Office of St. Joseph County, in a form acceptable to the Council Attorney <br />and the Common council, a covenant limited the use of the D -light industrial area <br />heretofore described to mini - storage warehousing or any use listed in the <br />C- Commercial District category of the South Bend Municipal Code. Renumber current <br />Section II to III., seconded by Council Member Serge. The motion carried on a roll <br />call vote of five ayes and four nays (Council Members Puzzello, Zakrzewski, Barcome <br />and Paszek.) <br />BILL NO. 94 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 3814 <br />LINCOLNWAY WEST IN THE CITY OF SOUTH BEND, INDIANA. <br />Council Member Beck made a motion to strike this bill, on the request of the <br />petitioner, seconded by Council Member Serge. The motion carried. <br />BILL NO. 95 -87 A BILL AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED WEST OF <br />NILES AVENUE SOUTH OF CORBY STREET RUNNING ALONG THE ST. JOSEPH <br />RIVER IN THE CITY OF SOUTH BEND, INDIANA. <br />This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Kathleen Cekanski - Farrand, Council Attorney, indicated <br />the bill should be amended in Section I, by adding the following to the end of the <br />section: Subject to the terms and conditions addressed in a letter dated June 15, <br />1987, to the Board of Park Commissioners and its two (2) exhibits namely "a" and "B" <br />addressing the East Bank Trail Project, copies of which are attached hereto and <br />included herein. Council Member Voorde made a motion to accept the amendment, <br />seconded by Council Member Taylor. The motion carried. Paul Barber, of MJK <br />Architects, Benton Harbor, indicated the petitioner planned to construct 22 luxury <br />condominiums of the 2.5 acre riverfront site. He indicated each of the units would <br />have its own two car garage and contain between 1,400 and 2,200 square feet of <br />space. He indicated the cost of the units would range in price from $125,000 to <br />$175,000. Ann Kolata, deputy director of Redevelopment, spoke in favor of this <br />rezoning. She indicated the developer has agreed to provide the City a 20 foot <br />easement along Niles Ave. to permit continuance of a jogging trail that had followed <br />an abandoned railroad right -of -way through the property. She indicated in exchange <br />the City will provide access to the north end of the site over property being <br />acquired by the Park Department. Council Member Beck made a motion to recommend <br />this bill to the Council favorably, as amended, seconded by Council Member Taylor. <br />-- The motion carried. <br />BILL NO. 106 -87 A BILL TO VACATE THE FOLLOWING DESCRIBED PROPERTY: THE 1ST <br />EAST -WEST ALLEY SOUTH OF VINE STREET RUNNING FROM THIRTIETH <br />STREET EAST TO THE INTERSECTING NORTH -SOUTH ALLEY, FOR A TOTAL <br />DISTANCE OF 165' MORE OR LESS. ALL BEING IN PART OF EGGLESTON'S <br />1ST ADDITION WITHIN THE CITY OF SOUTH BEND, ST. JOSEPH COUNTY, <br />INDIANA. <br />- This being the time heretofore set for public hearing on the above bill, proponents <br />and opponents were given an opportunity to be heard. Kathleen Cekanski - Farrand, <br />Council Attorney, indicated the bill should be amended in Section I, by adding the <br />following: subject to the petitioner dedicating additional right -of -way to the City <br />to allow traffic to make a turn movement either to the north or to the south from <br />the portion of remaining east /west alley, or an alternative plan acceptable to the <br />Board of Public Works. Said dedication must be recorded within sixty (60) days of <br />passage of the ordinance, or such plan must be approved by the Board of Public Works <br />within sixty (60) days of the date of passage of this ordinance. Council Member <br />Barcome made a motion to accept the amendment, seconded by council Member <br />Zakrzewski. The motion carried. Council Member Beck made the presentation for the <br />
